We are a law office providing advice to farmworkers on working/housing conditions, non-payment of wages, labor trafficking, sexual harassment, taxes, pesticide exposure, health insurance, (limited) immigration, and COVID-19 safety. We are a legal office funded by Legal Services Corporations that helps indigent farmworker migrant populations that come to the United States through the H2A program.

Hi everyone,

We are working on starting up outreach this year. Please message us if you'd like us to come to your farm, so we can arrange in advance safety measures for both you and us: masks, social distancing, and an outdoor space for the presentation!

In the meantime, we have been working on getting you information on COVID and how it affects you as you work this year. Scroll through the attached (the first 8 are in English and the second 8 in Spanish) to find out about your rights to a safe workplace and a safe home, paid sick leave, and what to do if you or a coworker is sick. We also cover new tax rules during COVID, health insurance, and what kinds of masks your employer should be giving you when working with pesticides during a nationwide mask shortage.

What counts as work time? Waiting time between jobs on the work site, travel time from one field to another, and breaks less than 20 minutes count as compensable time. Time between the labor camp and worksite do not count. Lunch breaks lasting for more than 30 minutes does not count either.

The Farmworker Law Project welcomes those H2A and other farmworkers who have arrived in the United States! The H2A transportation reimbursement for food is a minimum $12.09 per day and $51 maximum per day if proven with receipts. So keep your receipts and you will get a refund.
