Plaquemines Port Harbor & Terminal District v. Nguyen: La. Supreme Court Reaffirms Public Use Limits on Expropriation

Even where a public entity asserts a taking claim, it will fail if the property is effectively dedicated to a private party’s operations rather than a true public use by that public entity. For port authorities and other political subdivisions, this case serves as a cautionary tale: leasing expropriated property to a single private entity - - without genuine, demonstrable public use - - does not satisfy the constitutional requirement of public purpose.

We are proud to be part of Hogs for the Cause again this year, supporting an organization that continues to make a true impact.

This year’s festival raised more than $6.6 million for pediatric brain cancer. As part of The Pig Lebowski team, Jon Forester participated alongside nearly one hundred barbecue teams, earning 4th place in the Friday Night Party category with the band Flow Tribe playing live at their tent, and 7th place in the Side Dish category.

The two-day event is one of the largest barbecue and music festivals in the country, bringing together 30,000 attendees and 20 bands. We are grateful to the organizers for putting on such an incredible event and proud to support a cause that makes a difference for children and families.

A recent federal court ruling highlights an important risk for anyone using AI in legal matters.

In United States v. Heppner, Judge Jed S. Rakoff of the Southern District of New York held that documents generated using a public AI platform were not protected by attorney-client privilege or the work product doctrine. The defendant shared AI-generated research with counsel and claimed privilege, but the court rejected that argument in full.

The decision reinforces a fundamental principle: attorney-client privilege applies only to confidential communications between a client and a licensed attorney made for the purpose of obtaining legal advice. AI platforms do not meet that standard, and their data practices may allow user inputs to be stored, reviewed, or shared. As a result, information disclosed to an AI tool may not be considered confidential, and privilege cannot be created after the fact by sharing that content with counsel.
