Riess LeMieux was proud to be part of the Louisiana AGC Summer Conference last week, which brought together contractors, owners, engineers, and legal professionals for several days of industry updates, education, and relationship building.

Christopher LeMieux joined the conference’s Legal Update panel alongside Daniel Lund III of Phelps and Jacob Roussel of Breazeale Sachse, with Murphy J. Foster of Breazeale Sachse serving as moderator.

Jonathan Forester also attended the conference, making the trip an opportunity to connect with industry colleagues while enjoying some summertime fun with his family.

Louisiana’s prompt payment rules have changed, creating stricter payment obligations for private construction projects and public works projects.

Acts 822 and 255 shorten certain payment timelines, limit the ability to contract around prompt payment requirements, and increase the consequences of delayed payments and payment disputes. The updates also affect how public entities may handle contested liquidated damages on public projects.

In Wallace C. Drennan, Inc. v. Cantrell, the Louisiana Fourth Circuit affirmed mandamus relief and statutory interest awards against the City of New Orleans for late-paid public works invoices, reinforcing that public entities cannot avoid statutory interest by relying on internal payment processing practices outside a contractor’s control.

In 𝑆𝑎𝑖𝑧𝑜𝑛 𝑣. 𝐷𝑜𝑤 𝐶ℎ𝑒𝑚𝑖𝑐𝑎𝑙 𝐶𝑜., the Louisiana First Circuit reaffirmed that statutory employer immunity remains difficult to overcome in Louisiana, especially where a written contract establishes the statutory employer relationship and the plaintiff relies on the intentional act exception.

Zach focuses his practice on Construction Law and Litigation, as well as Commercial Litigation. He brings substantial experience representing clients in a variety of legal matters, including commercial disputes and employment law, along with a background in finance and real estate that provides valuable insight into the business challenges often underlying construction and commercial matters.

Zach earned his B.S.B.A. with a concentration in Finance and Real Estate from the University of Arkansas in 2018 and his Juris Doctor from Mississippi College School of Law in 2021, where he was a member of the Business Law Society.
