Ashley Robinson Promoted to Chair to the Design and Construction Committee of the ABA’s Real Property, Trust and Estate Law Section

D’Arcy Vicknair would like to congratulate its own Ashley Robinson for her promotion to Chair of the Design and Construction committee for the American Bar Association’s Real Property, Trust and Estate Law Section.

Having been appointed as Co-chair last year, along with years of assisting construction clients through every phase of a construction project, and a background in civil engineering, makes Ashley uniquely qualified to Chair this committee. All of us at D’Arcy Vicknair are delighted and excited to see all that Ashley will bring to this committee.

The Real Property, Trust and Estate Law Section is a leading national forum for lawyers which provides leadership and subject matter expertise on current regulatory and legal issues, trends, and best practices on property use, ownership, development, transfer, regulation, financing, taxation and disposal, trusts, estate planning, employee benefits, insurance, and probate and trust litigation.

The Design and Construction committee’s work focuses primarily on the contract documents that establish and document the risk allocation and respective contractual obligations of the various parties involved in designing and constructing improvements upon real property. The concerns of owners, insurers, lenders, designers, contractors, subcontractors, suppliers and construction managers are all addressed. This committee maintains a liaison with the ABA’s Forum on the Construction Industry, American Institute of Architects and other similar industry groups.

“Ethical Considerations When a Surety Tenders Its Defense to Its Principal” by Adrian D’Arcy Featured in Surety Bond Quarterly

The National Association of Surety Bond Producers (NASBP) recently published the second of a two-part article series authored by Adrian D’Arcy in its Surety Bond Quarterly’s summer 2026 edition, titled “Ethical Considerations When a Surety Tenders Its Defense to Its Principal.”

In this second part, Mr. D’Arcy focuses on the issue of how, once a surety tenders its claim to its principal’s attorney, that attorney should proceed with the dual representation and the ethical hurdles involved. Specifically, the article discusses client communications and confidentiality, ethical issues with the client paying the attorney, ethical issues with the surety wanting to settle the principal’s claims, and issues that may arise post representation. In addition, this second part of the covers some court decisions addressing whether the earlier dual representation prohibited the attorney from representing one of the parties in subsequent litigation.

As noted in the first part of the article, tendering defense can be an attractive option for sureties and principals who wish to reduce costs and attempt to streamline the litigation process but the risks and the substantive ethical considerations must be considered as well when a surety considers tendering its defense.

Adrian D’Arcy and Ashley Robinson to Co-Present a Virtual Seminar for the NASBP: Beyond the Click: Legal Realities of E-Signed Indemnity Agreements

Fresh off his appointment to the Attorney Advisory Council of the National Association of Surety Bond Producers (NASBP) Adrian D’Arcy, alongside Ashley Robinson of D’Arcy Vicknair, and longtime friend and colleague, Ryan J. Springer (EMC Insurance Companies), are delighted to present a Virtual Seminar for the NASBP titled “Beyond the Click: Legal Realities of E-Signed Indemnity Agreements,” on April 22, 2026 at 2:00 (Eastern).

Electronic signatures – or as we may know them: the darling of the modern efficiency world. They are quick, efficient, and perhaps a bit too accommodating on occasion. While e-signatures are generally valid under federal and state law, critical provisions—particularly attorney-in-fact and power of attorney clauses—often trigger heightened statutory requirements such as notarization, witnessing, or even prohibitions on electronic ex*****on in certain jurisdictions and when executed electronically may not be self-proving. Adrian, Ashley, and Ryan look forward to presenting a webinar that combines a legal prospective from outside counsel, a practical prospective from the surety, and a few “war stories.”
