APPELLATE VICTORY - Trial Court Reversed and Case Dismissed With Prejudice.

In a succession dispute involving Mississippi real estate, a brother and sister sought to annul a warranty deed of property transferred by their mother to the opposing parties' brother and have Mississippi property returned to a Louisiana succession. Shane argued that the 15th Judicial District Court lacked subject matter jurisdiction because the lawsuit directly challenged title to immovable property located in Mississippi. After the trial court denied the jurisdictional exception, an application for supervisory review was made to the Louisiana Third Circuit Court of Appeal. The Third Circuit granted the writ, REVERSED the trial court's ruling, sustained the exception of lack of subject matter jurisdiction, and DISMISSED the lawsuit WITH PREJUDICE.

After 4 years that included an administrative appeal to U.S. Fish and Wildlife Service, a FOIA appeal that required USFWS to reimburse over $30,000 in attorney’s fees, and a federal Administrative Procedure Act federal lawsuit, the District Court of Alaska issued an 89-page opinion in our favor finding USFWS’s actions arbitrary and capricious.
