IMPORTANT UPDATE: Have DACA or an adjustment of status case pending? This travel rule just changed.
A new BIA decision means traveling on advance parole can now count as a “departure” — which could trigger unlawful presence bars. This affects DACA recipients, and other green card applicants who accrued unlawful presence.
We strongly encourage those impacted by this rule to not travel on advance parole without talking to an attorney first.
