As of July 1, we can now use small estate affidavits to transfer wealth after death up to $100,000 (in Indiana)! This will save a lot of people from probate BUT it will only transfer assets to the heirs indicated in the Indiana Code if you don't have a will in place directing otherwise. Robinhood Investors: you can now name death beneficiaries for your Robinhood accounts! So far, you cannot name trusts and, as always, there can be problems if you name children. It's a big year for estate planning! Indiana updated its rules for Healthcare Powers of Attorney last year to go into effect at the beginning of this year. We've been meticulously updating our new forms to comply with the new law and we've been rolling them out since December. Specifically, the new form wraps the living will into the document and gives you the ability to include your health care and end of life preferences within the power of attorney. If you have an old healthcare power of attorney, it is still valid though only the new form will be accepted for powers of attorney made after January 1. If you would like to update your healthcare power of attorney, if you don't have one, or if you just have questions, now is a great time to talk to us! Just give us a call.

Almost every client that comes into our office expects that they need a will. Often, we can implement an estate plan that avoids a will (and its cost) entirely. Additionally, it frequently turns out that lifetime directives (powers of attorney, healthcare representative appointments, living wills) may be more important to the client than the will or trust itself.

Estate plans are NOT one-size-fits-all and the primary cost of a person's estate usually comes in the form of probate fees. In other words, a cheap will might ultimately cost your heirs thousands of dollars in unnecessary fees while a trust might save the same. More and more websites are offering cheap document generation services, preying off of general consumers' lack of understanding of the estate administration process. Don't fall for it. If you are going to make an estate plan, you need to meet with a knowledgeable attorney who can guide you through the process and help you create an estate plan that is tailored to your own circumstances and is cost effective both now AND after you pass away.

Did you know? If both of a child’s parents pass away, a court must decide who the child’s guardian will be. The Court’s highest priority consideration will be the parents’ guardian recommendations in their wills. Without wills, the Court will not have the benefit of knowing their choice.
