For professionals whose work involves AI or related technologies and who are considering O-1A, EB-1A, or EB-2 NIW pathways, the terminology change raises a narrow question: does it alter immigration eligibility standards?

On its face, the order does not amend the Immigration and Nationality Act or change the eligibility standards for those classifications. Individual petitions remain evaluated under the applicable legal standard and evidence in the record.

From October 1, 2026, applicants for I (foreign media), TN and TD visas are instructed to set their social media profiles to "public." It's the latest step in a screening framework that has expanded steadily since 2019.

The change widens the government's online-presence review. However, it doesn't change who qualifies for these visas, and it doesn't specify what officers are looking for.
What to know how this applies to your case?

A federal court has paused the rule that would end "duration of status" for F-1 students and J-1 exchange visitors.
The DHS rule was scheduled to start on September 15, 2026, replacing duration of status with a fixed end date on the Form I-94. On September 14, the U.S. District Court for the District of Massachusetts postponed it and blocked DHS from putting it in place while the litigation continues.
For now, nothing changes. Duration of status still governs. F-1 and J-1 holders are not being switched to four-year fixed dates, and there is no new Form I-539 to file simply because the rule was published. The court paused the rule rather than striking it down, so its future is still unsettled.
Because guidance here is moving quickly, confirm the current status of your case before making time-sensitive decisions, especially around travel, program extensions, or OPT.

The public charge rule changed on September 18, 2026. For high skilled and investor applicants, the practical focus is on how USCIS evaluates the applicant’s overall circumstances, including financial and professional factors.
For those planning an adjustment of status, two things are especially important: understanding which rules apply based on timing and making sure the application is supported by clear, relevant documentation.

The September Visa Bulletin barely moved, and that is the part worth understanding.
Several employment based categories stayed put this month. At the same time, September is the last month of the fiscal year, and the State Department has warned that some categories could retrogress or become unavailable before it closes.
That makes the lack of movement worth a closer look. In particular, “Current” does not necessarily mean “approvable,” as the implications can vary depending on the category, country of chargeability, and priority date.
Wondering how these developments could affect your case?

Six months in. Is it really too soon to think about immigration?
Founders ask this question all the time. The short answer is no.

The most common pathways for founders, including EB-1A, O-1A, EB-2 NIW, E-2, and L-1A, look at different aspects of the founder, the work, the investment, or the business plan. The age of the company is not automatically a dealbreaker.

In fact, L-1A includes a pathway specifically for opening a new U.S. office, so being early can be part of the strategy rather than a weakness.

That’s why stage matters less than strategy. What matters is having meaningful traction, choosing the right evidence, and building the case around the pathway that actually fits the profile.

So before deciding it’s “too early,” take a closer look. Waiting may create a timing problem where there wasn’t a merit problem to begin with.
