¡Carga pública ha mu**to!

https://www.dhs.gov/news/2021/03/09/dhs-secretary-statement-2019-public-charge-rule•

DHS Secretary Alejandro N. Mayorkas announced that the government will no longer defend the 2019 public charge rule as doing so is neither in the public interest nor an efficient use of limited government resources.

Public charge is dead! This is the best news we have had the privilege to share in a long time. A little background: The previous administration promulgated a federal regulation adding horrible layers to the public charge determination immigration officials make when adjudicating permanent residence (and they added the inquiry even to change or extension of status cases). The 2019 public charge regulation on its face purported to simply ask if folks had received public benefits. Keep in mind, though, that immigrants were already ineligible for those public benefits and therefore already were not receiving them. The 2019 rule also asked applicants to lay bare their entire financial existences, including 12 months worth of all bank statements, evidence of any and all assets and debts, and asked for all income and asset information even from all their household members. It asked for credit reports and scores. The prong that really seared my soul was the part asking if the applicant had any medical conditions that would impact self-sufficiency, and the examples given were diabetes and the like. It was undisguised racism and classism.

Indeed the 2019 public charge rule was inconsistent with giving immigrants a fair shake and treating humans as more than a dollar sign. Any now it's over!

DHS Secretary Alejandro N. Mayorkas announced that the government will no longer defend the 2019 public charge rule as doing so is neither in the public interest nor an efficient use of limited government resources.

The U.S. consulates abroad have been mostly closed for almost one year now and applicants have been waiting... and waiting.... and waiting. We look forward to innovations in visa processing that will allow consular officers to safely work through the backlog.

The suspension of most legal immigration, combined with the pandemic, has left visa applicants in limbo. Even if President Biden ends the bans, it could take years to process everyone.
