REVERSAL OF TRIAL COURT DECISION OBTAINED ON APPEAL

NAPLES, FLORIDA (June 10, 2022) – Grant Fridkin Pearson, led by Jeff Fridkin as co-counsel, recently obtained reversal of a trial court decision which had found its client’s commission agreement to be an unlawful restraint of trade. At stake in the matter is a claim by an insurance agent against another insurance agent for its share of insurance commissions involving many millions of dollars. In the case of Capital Wealth Advisors, LLC v. Capital Wealth Advisors, Inc., the Second District Court of Appeal has ruled that the commission agreement, which requires the sharing of commissions when a policy is generated through referral sources identified in the contract, was not a restraint of trade because it does not prohibit any solicitation or competition. According to the Second District, “The Agreement does not negatively affect consumers’ ability to procure insurance products since both the Company and the Agent can freely compete for the same business.”
