Filing bankruptcy (Chapter 7 or Chapter 13) temporarily stops foreclosure activity. 🏡⚖️ But understanding the difference between the two matters — because timing can be everything. ⏳

📄 Chapter 13:
As long as the bankruptcy remains active and required payments (including trustee payments) continue to be made, foreclosure activity generally remains paused. This can create time and structure while working through a repayment plan. 🤍

📄 Chapter 7:
Chapter 7 often creates a shorter pause. The automatic stay may be lifted later in the process, including after the creditors meeting or discharge, depending on the situation. Foreclosure activity may then resume. ⏸️➡️🏠

A redemption period is a legally defined timeframe when a homeowner may still have the right to reclaim their property. The timing and rules vary by state, and depending on where you live, it may happen before or after the auction date. ⚖️

What’s important to understand is this:

In many cases, yes — you can begin the process. 🙏

However, most sales cannot close until the bankruptcy is discharged, which is typically around 3 months after filing.

If you’re considering a short sale, timing matters even more ⏳ especially if an auction date existed before filing.

A Chapter 7 temporarily pauses foreclosure through the automatic stay… ..but eventually the foreclosure process may resume.

This is why having the right team matters. 🤍 Your real estate agent and bankruptcy attorney should be working together throughout the process.

In many cases, yes — you can begin the selling process while in a Chapter 7 bankruptcy. However, most sales cannot be completed until the bankruptcy is discharged, which is commonly around 3 months after filing. 🤍

If you are considering a short sale, timing becomes especially important. In many situations, it may be beneficial to begin the process early — especially if an auction date was already scheduled before filing a bankruptcy. ⏳🏛️

One thing many homeowners don’t realize is this:

A Chapter 7 bankruptcy does not permanently stop foreclosure. It creates an automatic stay, which temporarily pauses the foreclosure and auction process.

Eventually, the auction may be rescheduled:
1️⃣ If the automatic stay is lifted
2️⃣ Once the bankruptcy is discharged

This is why timing, communication, and the right guidance matter. 🤝

Bankruptcy + foreclosure + selling a home can involve many moving parts, and your real estate specialist and bankruptcy attorney should work closely together to help guide the process.

I read a letter I often send to homeowners who may be struggling.

Because behind every foreclosure notice, missed payment, or unopened piece of mail… there is a person. A family. A story. 💔

The kind of seasons that keep you up at night. The kind where you carry the weight quietly because you don’t know what to do, who to trust, or where to turn.
