If you are listing or selling real property in Idaho, beware. A recent Idaho Supreme Court Decision issued on January 17, 2025: Rose v. Martino has completely changed the landscape for real estate transactions in Idaho, especially if you indicate in the Purchase and Sales Agreement that the real property is being sold "as-is". The "as-is" clause means nothing if you fail to exclude this warranty waiver in the issued General Warranty Deed at closing.
