We recently filed an appeal to the California Supreme Court asking it to stand by its previous ruling that Penal Code section 632 (unlawful recording of confidential communications) is a specific intent rather than general intent crime. The Court’s ruling will be key to many defenses we intend to raise at an upcoming jury trial. The Court has ruled on this issue in1969 but has not addressed it since then. The Attorney General has been ordered to respond to our appeal and we anticipate a decision soon.

In a first of its kind criminal prosecution in California, a Christian pastor was charged with a misdemeanor after hosting an outdoor worship and baptism service near the Huntington Beach pier. The service took place when indoor church services were shut down due to COVID-19 concerns. To address those concerns, the religious service was conducted on the beach with the baptisms taking place in the Pacific Ocean.

The Huntington Beach Police Department issued the pastor a citation for hosting the event without a permit and ordered him to appear before the Orange County Superior Court for violating the Huntington Beach Municipal Code by holding a “large scale event.”

After nearly 10 months of legal wrangling, the case was thrown out after we were able to convince the prosecutor that the religious service did not constitute a criminal offense, nor did the pastor violate the city’s ordinance because his religious service did not meet the legal definition of a “Permit Required” event.

City officials say event organizers are violating state-mandated safety measures such as social distancing and wearing masks. About 300-400 participants attended.

In court last Thursday with Pastors Mike McClure and Carson Atherly of Calvary Chapel San Jose. They have been sued by the Santa Clara District Attorney’s Office and the County Counsel’s Office for holding indoor and in-person church services. The church and the pastors have been held in contempt of court and face more than $1 million in administrative fines.
