Yesterday, I argued a case in front of the Kentucky Supreme Court, which was Chief Justice VanMeter's last oral argument before retirement. After arguments concluded, I received the following email from a firm out of Louisville, which sums up why this particular case is so important:

"Chris,

We watched your oral argument this morning and wanted to tell you that you were fantastic.

The case is an important one, and your skilled advocacy served your client well.

It is hard to say which way the Supremes might go - it seemed clear that the Court was divided but the final tally seems hard to predict.

As a firm that handles abuse/neglect cases frequently, we were thrilled with how you framed the legal arguments today. Family Court works best when the judges treat it like a real court and not just make up stuff along the way.

BODY WORN CAMERA EVIDENCE DIFFERED FROM OFFICER TESTIMONY, EVIDENCE SUPPRESSED:
A hearing was held in the Graves Circuit Court after Chris filed a motion to suppress the evidence obtained from our client’s vehicle during a traffic stop. The law enforcement officer that pulled our client over late at night testified the license plate was not illuminated. However, after submitting as evidence still frames from body worn camera showing plainly that our client’s license plate was brightly illuminated after she was stopped, and the office being unable to provide a reasonable explanation for the discrepancy between his testimony and the photographic evidence, the Graves Circuit Court ruled the traffic stop was unreasonable and all evidence obtained of criminal offenses allegedly committed by our client after the traffic stop would be suppressed and unavailable to the prosecution at trial. The charges against our client were dismissed because of the court’s ruling.

COURT OF APPEALS REVERSED FINDING OF ABUSE:
A ruling of the Calloway Family Court that our client had neglected or abused his child was appealed to the Kentucky Court of Appeals. After briefing the issues presented on appeal, the Court of Appeals reversed the judgment of the Calloway Family Court. The Court of Appeals ordered the petition against our client to be dismissed, reversing the finding of neglect or abuse.

KNOCK AND TALK UNREASONABLE SEARCH:
Following a hearing in the Calloway Circuit Court on a motion to suppress evidence obtained during a “knock and talk” at our client’s residence, the court ruled law enforcement officers conducted an unreasonable search of the client’s property when they made no effort to knock on the front door but instead went to the back door and began knocking while on the deck adjoining the house. Because the rear of a residence is not typically a location the general public would be expected to go, the same restrictions apply to law enforcement when attempting to speak with a resident. The officers also knocked on our client’s windows for several minutes. Evidence obtained as a result of the “knock and talk” was ordered to be suppressed and unavailable for the prosecution to present at trial. The charges against our client were dismissed due to the court’s ruling.

FELONY JURY TRIAL:
In the Carlisle Circuit Court, Chris represented a client at trial Charged with Fraudulent Use of a Credit Card, value $1,000 or more, a class D felony, punishable by up to five years in prison. After presentation of all evidence and closing arguments, the jury returned a verdict of guilty of Fraudulent Use of a Credit Card, value less than $500, a class B misdemeanor. The jury recommended a fine of only $250 and no jail time for our client.

This week, I'll be featuring some of the successes my clients have had over the past several months.

After filing a motion to suppress evidence obtained as the result of a search warrant, Chris challenged probable cause for issuance of the search warrant in the Calloway Circuit Court. Following a hearing, it was proven the affidavit for the search warrant contained a material misstatement of fact and excluded other material information. The Calloway Circuit Court ruled the misstatement and the excluded information, if known by the judge that issued the search warrant, would not have resulted in probable cause and the search warrant should not have been issued. As a result, the court suppressed all of the evidence obtained after the search warrant was executed and the charges against our client were dismissed.
