FAMILY LAW FAQ

Do I need an attorney for an adoption?

Adoption can create a new family or add to an existing one. The end of the adoption process, therefore, is typically filled with joy and happiness; however, the road to get there can include a number of obstacles and roadblocks. Having an experienced Tennessee family law attorney on your side will ensure that those obstacles and roadblocks don’t prevent you from reaching the end of the road.

PROBATION FAQ

What is probation?

Probation is a sentencing alternative to incarceration that allows a defendant to serve a sentence in the community instead of in jail or prison. You can be sentenced to serve a period of time on probation in addition to, or in lieu of, being sentenced to a period of incarceration. Typically, the judge will actually sentence you to a period of incarnation and then suspend that time and allow you to serve that time on probation instead. Keep in mind, however, that the suspended sentence can be reinstated if you violate your probation. Learn more at https://www.stanbennettlaw.com/probation-tennessee-need-know/

DIVORCE FAQ

What are the steps in a divorce?

A divorce begins when one spouse (the “Petitioner”) files a “Request (Complaint) for Divorce.” The Request must be served on the other spouse (the “Respondent”) to ensure that he/she is aware of the proceedings and is given an opportunity to respond. If the Respondent files a written “Answer” it means both parties are planning to actively participate in the process. If no Answer is filed, the Petitioner may request a default judgment after the required waiting period. Ideally, the parties are able to resolve all issues in a Marital Settlement Agreement without the need for lengthy, and costly, litigation. If an agreement is not possible, the Discovery process will begin wherein both sides provide relevant information to each other. Mediation may be ordered by the court in an attempt to avoid a trial. If contested issues remain, the case will be set for trial at which time the judge/jury will decide the outcome of those issues. Learn more about the Tennessee divorce process at

CRIMINAL LAW FAQ

What are some of my Constitutional rights?

In the United States, we are all protected by a number of important rights enumerated in the United States Constitution. The most commonly used of these rights are located in the Amendments to the U.S. Constitution and are collectively known as the “Bill of Rights.” Some of these rights you have likely heard recited on television, such as your right to remain silent. You have other important rights as well though, such as your right to an attorney, a right to confront and cross-examine witnesses against you, and a right to be free from unreasonable searches and seizures. DIVORCE FAQ

How are debts and assets divided in a divorce?

During the course of a marriage a couple accumulates both debts and assets. Those debts and assets must, therefore, be divided in a divorce. Tennessee requires an “equitable” division of marital debts and assets. Equitable does not necessarily mean “equal.” Instead, equitable means “fair.” Learn more about how debts and assets are divided in a Tennessee divorce at https://www.stanbennettlaw.com/dividing-debts-and-assets-in-a-tennessee-divorce/

WILLS AND PROBATE FAQ

What happens if I die without a Will in place?

When a decedent left behind a valid Will, he/she is said to have died “testate.” When no valid Will was left behind by the decedent, the decedent is said to have died “intestate.” If you die intestate, the State of Tennessee decides how your estate assets are distributed using the Tennessee intestate succession laws. Usually, this means that only close relatives will inherit from the estate in most cases.

FAMILY LAW FAQ

Can a father get custody of his children?

Historically, the presumption was that the mother would be awarded custody of minor children in a divorce. Of course, few fathers ever wanted custody of their children so the presumption was rarely questioned. Times have changed though. Today, fathers are more involved in child rearing and many even fight for custody in a divorce. DUI FAQ

Does a law enforcement officer need a legal reason to stop me?

Although it may appear that police officers stop vehicles on a regular basis for no apparent reason, the law requires an officer to have a legal reason for effectuating any traffic stop. That reason may be something minor, such as a missing license plate light or a loud muffler, but it must exit for a stop to be legal.

DIVORCE FAQ

How does the divorce process work in Tennessee?

The divorce process begins with the filing of a Complaint by the Petitioner (the person who initiates the divorce). The Complaint, along with a Summons, is served on the Respondent (the other spouse) who then has a limited amount of time within which to file a written Answer. If no answer is filed, the Petitioner can ask for a default judgment. If an Answer is filed, the parties may work out an agreed settlement and file it with the court or the case will proceed to the discovery stage. Mediation may follow. If an agreement is still elusive, the case will eventually go to trial. Learn more at

The complaint is the document that is filed to open the court case and will include essential information about the parties as well as explain what you want out of the divorce. Learn more about divorce process in Tennessee in this presentation.

CRIMINAL LAW FAQ

What should I do if the police want to question me?

One of the most common mistakes people make is “talking” to the police when they are just a witness, “person of interest,” or suspect. People frequently think they can talk their way out of being arrested when, in reality, that rarely ever happens. The police are trained to question suspects – they do it every day for their job. If you have not been placed under arrest, or are not officially in custody, the police are not required to read you your rights. That does not mean you are not considered a suspect nor does it mean that what you say will not be used against you if you are arrested. Anytime the police want to talk to you it is in your best interest to exercise your right to remain silent until you have the opportunity to speak to a criminal defense attorney. Find out more at https://www.stanbennettlaw.com/need-lawyer-police-want-talk/ about your right to remain silent when questioned by police.
