"Advance Directive" .....What Is an Advance Directive???

An "Advance Directive" is an important estate planning legal document.

An "Advance Directive" is a set of instructions that explains the medical care/treatment a person does or does not want to receive if the person loses their ability to self-advocate (incapacity etc.).

An "Advance Directive" allows a person to appoint their personal "Healthcare Representative" to decision making purposes and to make medical decisions.

Every person can benefit from an "Advance Directive" including persons with chronic health conditions or disabilities.

No one knows what happens tomorrow....life has uncertainties..,.

"Advance Directives" are important!

WHAT IS AN "ADVANCE DIRECTIVE"?

Indiana, by statute, enables a person to make an "Advance Directive" which is an Estate Planning" tool.

An "Advance Directive" allows a person to appoint a healthcare representative to make healthcare decisions for a person who lacks capacity to make decisions, to consult/communicate with a person's healthcare providers, and gives the appointed healthcare representative access to the individual's confidential healthcare/medical information/records.

An "Advance Directive" also allows a person to express his/her wishes concerning end of life care.

An "Advance Directive" allows a person to appoint an initial healthcare representative and a secondary healthcare representative in the event the primary healthcare representative is unavailable to act.

An "Advance Directive" may help to avoid a future costly "Guardianship" related proceeding.

Every person should consider having an "Estate Plan" and/or updating their "Estate Plan".

HOW TO PREVENT A COSTLY GUARDIANSHIP!!!!?????

In Indiana, what can an Adult Person do to prevent a Court Appointed Guardian should an Adult Person suffer a future incapacity (debilitating health condition) and become incapable of handling personal affairs?

Understand a Court Guardianship Proceeding can be a time consuming expensive (costly) process and prolonged Court proceeding with Court costs, attorney fees, GAL Fees, litigation relation expenses, and with uncertainties.

Indiana law generally provides that if less restrictive means are available then the Court is not to grant a "Guardianship" over an incapacitated adult person.

So how can proper Estate Planning help an adult person to avoid costly Court guardianship proceedings while honoring a person's important wishes, intentions, and desires?

An Adult Person, while having proper capacity, should consider having an Estate Plan with the following legal instruments:
1. General Durable Power of Attorney with financial powers;
2. Advance Directive with Durable Healthcare Powers (also may contain living will declaration);
3. HIPPA Waiver to release private financial and health related information; and,
4. Last Will & Testament.
