With a government shutdown on the horizon, here’s how immigration-related federal agencies may be affected. Clients with active immigration cases should stay in touch with our office for the latest updates.

Department of Homeland Security: Most of DHS’s work is considered essential, so DHS will remain open.

U.S. Citizenship and Immigration Services: USCIS will remain open as it does not rely on Congress for its funding. The few programs that are funded by Congress, such as E-Verify, may face delays during a government shutdown.

Department of State: Visa and passport operations will remain open, however, depending on how long the shutdown lasts, work might become limited to diplomatic visas and emergencies at certain consulates/embassies.

Customs and Border Protection: U.S. ports of entry will remain open, however, applications that are filed at the border may be impacted.

Immigration and Customs Enforcement: ICE enforcement and removal operations will continue. The ICE Student and Exchange Visitor Program (SEVP) offices will remain open.

Executive Office for Immigration Review (Dept. of Justice): Immigration court cases for detained individuals (the “detained docket”) will continue during a government shutdown. All other cases will be rescheduled for a later date.

Department of Labor: DOL’s Office of Foreign Labor Certification (OFLC) will stop all operations during a government shutdown.

Congressional Constituent Services: Some congressional offices may be closed during a government shutdown. Please contact the individual congressional office for more information.

Wrapping up a day at USCIS with wins on two immigration cases! Our client began her green card journey just weeks before COVID restrictions on international travel and visa processing went into effect. Today, over five years later, her application for Naturalization was approved and she’s now a U.S. Citizen! Not only that, we were able to get her Petition to Remove Conditions on her Lawful Permanent Residence approved, which will allow her to go straight to her Citizenship Oath Ceremony later this summer.
