I have said it before and I will say it again, you cannot simply add a little dazzle dazzle to someone else’s trademark and make it your own.

Hermes has triumphed over the ‘MetaBirkin’ NFTs in their pursuit to end the continued creation and sales of Rothschild’s virtual art. The jury has spoken and they have found Rothschild liable under trademark law of trademark infringement.

So what does this mean for other digital artists?

So, why not use this momentous occasion to give a quick trademark lesson Super Bowl Edition.

Did you know that you can trademark:

1) The Name of Your Game/Event
2) The Name of Your Team
3) Your Team’s Logo

Why is this important? You could 🛑 folks from selling unauthorized merch. You could increase the price of “Official” merch, etc. You could stop folks from putting on similar games/events with your game/event name, team name, or logo design.

📣 I have said this once and I will say it again— You cannot just put a little “razzle dazzle” on an existing trademark and make it yours!

Let’s get into it!

Basically, two DC go-go music gatekeepers that led protests against restrictions on the enjoyment of go-go music in a gentrified DC neighborhood later started a concert series titled “Moechella” 👀 and unsuccessfully attempted to file this mark with USPTO. Long story short Coachella blocked the registration of the mark and has now filed a lawsuit to prevent the continued use of the mark completely. I am interested to see how this legal battle will play out. Thoughts?
