USCIS has just issued a new memorandum making one thing VERY clear: Adjustment of Status is NOT automatic even if a person is eligible.

In other words, it is no longer enough to simply “qualify.” USCIS is emphasizing that officers may deny cases as a matter of discretion after reviewing both the positive and negative factors in a person’s case.

⚠️ This means that:
• mistakes in applications,
• inconsistencies,
• prior immigration issues,
• improper entries,
• fraud,
• omissions,
• or even the way a case is presented…

can seriously affect a green card application.

That is why now MORE THAN EVER it is important for your case to be prepared correctly from the beginning.

Adjustment of Status is NOT just filling out forms.

It is a legal strategy.

Many cases that appear “simple” become complicated because of poorly prepared applications, insufficient evidence, or incorrect advice.

USCIS acaba de emitir un nuevo memorándum dejando claro algo MUY importante: el Ajuste de Estatus NO es automático aunque la persona sea elegible.

En otras palabras, ya no basta solamente con “calificar”. Ahora USCIS está enfatizando que los oficiales pueden negar casos por discreción, analizando factores positivos y negativos de cada persona.

⚠️ Esto significa que:
• errores en aplicaciones,
• inconsistencias,
• problemas migratorios previos,
• entradas incorrectas,
• fraude,
• omisiones,
• o incluso cómo se presenta el caso…pueden afectar seriamente una residencia.

Por eso ahora MÁS QUE NUNCA es importante que su caso sea preparado correctamente desde el principio.

Un Ajuste de Estatus NO es solamente llenar formularios.

Es una estrategia legal.

Muchos casos que parecen “simples” terminan complicándose por aplicaciones mal preparadas, evidencia insuficiente o consejos incorrectos.

Imagine this.
You are 18 years old. You were born in Venezuela, but you are also Muslim and Syrian. Your older brother kidnapped, your father threatened.All because of your nationality and religion.
Your father moves the family to the USA. You present yourself at the border and your family is released .
Yet you are given an ankle bracelet for 8 months. You file your asylum application with the court.
You then are required to check in with ICE . For 5 years. Perfect record of compliance.
You get TPS, you get your work authorization. You continue working, waiting for your case to be heard at the court. Not a single day working without authorization. Government terminates TPS, but you still have your asylum case pending. Delays at the court… none caused by you rather caused by a government that only wants chaos and confusion.
Fast forward to April 29,2026, when you attend your annual check in . And all of
The sudden the government changes their mind and detains you. No reason no explanation… no rhyme or reason. Except filling a daily quota…a campaign promise to deport millions of immigrants…

No criminal record, taxes filed yearly, perfect compliance with the court’s requirements. You already have a court date for your asylum. Yet you are now detained… miles away from family. Days without a proper meal because the detention center doesn’t have Halal foods. Your father moving earth and heaven to get you out.
Every meeting I see that father being chipped away, crying, nervous, fearful.

So we start again, to guide this family to our immigration system. An unfair, ugly and difficult system. Explaining the process… reassuring them.. supporting them.

Finally, the hearing… scheduled for 1 pm. I’m ready. My arguments.. the evidence… as I wait for an unreasonable amount of time… the hours goes by and I’m still looking at screen with a message 14 people in the waiting room…..3:45 finally here we go!!
I take my time… developing the record,,, element by element. Arguing against a determination that this kid- now 22- is a danger to the community and a flight risk. 167 pages of evidence supporting the argument… the government process zero evidence … not even one document.

My heart is racing … as the judge starts presenting his decision. My mind racing .. hopeful but also knowing that it can go either way.

Finally bond granted…I can breathe now. The father can’t stop crying … we won…

Today’s win hits different.

This client has been fighting for this day since 2019. A removal order was entered back in 2012.
We first fought to reopen and terminate the removal proceedings. Then came a green card application with USCIS that was incorrectly denied, sending the client right back into removal proceedings all over again. More delays. More stress. More legal fees. More waiting.

We filed a new application before the Immigration Court and kept fighting.

Today, after years of litigation and perseverance, the Immigration Judge granted lawful permanent residence. GREEN CARD APPROVED IN COURT TODAY.

Cases like this are a reminder that immigration journeys are rarely simple. Sometimes they take years of resilience, faith, patience, and refusing to give up even when the system gets it wrong.

Today, this family can finally breathe a little easier. 💚

✨ One green card approved and received
✨ One divorce finalized
✨ Two custody orders granted

Last week we had a great 🏆 win!

My client spent 80 days in detention.

Eighty days away from his family.
Eighty days waiting.
Eighty days hoping the system would be fair.

His first bond hearing? No interpreter. No real opportunity to be heard.
His second bond hearing? Denied in less than 2 minutes. A sham.

That could have been the end of the story.

But we didn’t stop.

We went to federal court. We filed a habeas. We pushed back.

And today, we walked into court with the truth on our side — and a judge who was finally required to listen.

The government had to prove he was a danger or a flight risk.

They couldn’t.

Because the reality was always clear:
✔ No criminal record
✔ Years of compliance
✔ A man who did everything asked of him

Bond granted — $5,000.

After 80 days… he gets to go home.

This is why we fight. Because sometimes the system gets it wrong — and when it does, we don’t stay quiet.

We push. We challenge. We show up again.

Today, justice showed up too.
