Chapter 13's are plans that pay the attorney fees and secured loans (think cars and furniture) through a plan generally between 3 and 5 years and discharge the unsecured loans. The amounts are based on a particular debtors circumstances and can significantly reduce the outgoing expenses from a budget. You can put house arrears into the plan too. It stops foreclosures and repossessions immediately and can help you reorganize your finances and keep your home and transportation.

One of the first questions about bankruptcy is what is the basic difference between a chapter 7 and a chapter 13. A chapter 7 is the basic liquidation bankruptcy, any assets or equity above the allowed exemptions can be liquidated in certain circumstances and distributed to unsecured creditors, this does not happen in most of our cases though. The unsecured creditors are discharged (you do not have to pay them) and the secured creditors are treated i a few different ways depending on circumstances. Basically you can keep making the payments and keep the collateral (think car), redeem the collateral which means pay the actual value a creditor would get if it were liquidated (think furniture or getting a new loan to pay that value and have a new creditor where you owe a lot less which is called a redemption loan, think car) or surrender the collateral and not have to pay anything else on it. Chapter 7's are one time fees and generally go to court one time and are discharged usually in about 4 months from filing.
