I had the opportunity over the last week to attend the National College for DUI Defense's Serious Science for Serious Lawyers. Panel members included nationally recognized trial advocates and scientists. We studied aspects of metrology, blood alcohol and more complex blood drug analyses. We worked on trial advocacy skills and how to present the science to judges and jurors. I am fortunate for all that I learned at this seminar and also being part of a great group that strives to do the very best for our clients.
In this third part of this series, James Nesci joins the NC DWI Guy to reveal how to use basic math principles to attack breath machines. James Nesci has been board certified by the National College for DUI Defense since 2001 and served as the College’s Dean during the 2016-2017 academic year. Mr. Nesci often defended cases well into the .30 blood-alcohol range. He was one of the lead attorneys on the Intoximeters RBT-IV breath-testing issue in Southern Arizona which resulted in the suppression of breath tests in over 7,000 cases. He is one of only a handful of attorneys in the country who has ever held a DOT-Compliant Permit to operate an Intoxilyzer 8000. Hear the full conversation here:

The fact that the evidence against a particular defendant might be—or at least seem to be—damning or overwhelming does not dilute the obligation cast upon the criminal defense bar. The fact that there are many who are either ignorant of or unsympathetic to this constitutional right does not alter the fact that lawyers have a special obligation to give vitality to the right. —National College for DUI Defense
The National College for DUI Defense (NCDD) 2020 Winter Session is coming to Scottsdale in January. Craig Rosenstein a proud member of this organization and will be speaking at this seminar on Day 1. NCDD states that the mission of the National College for DUI Defense® is to provide the finest advanced-level training available to the DUI Defense Law practitioner and In sum, that the mission of the college is to vindicate the promise of the United States Constitution, that a citizen accused has the right to the effective assistance of his or her counsel.
What happens in Vegas doesn't always stay there. Thankfully member John Rapp brought back a whole bunch of new learning material thanks to the National College for DUI Defense conference last week.
