Yesterday I had the privilege of sharing the stage with the brilliant minds of Olga V. Mack, Dazza Greenwood, and our stalwart moderator Brian Schaller from InfoLawGroup LLP to discuss "Legal Ethics & AI" at the 2023 Institute on Entertainment Law and Business at USC. The crossroads of AI and legal ethics has been a special interest of mine for the past several years as I have analyzed and discussed how regulators can promulgate regulations and revise rules of ethics that best protect the public yet do not stifle technological innovation in the legal profession. My article, "Does SB 42 Create More Problems Than It Solves?" was published today by CEB. This article reviews the proposed bill that would require California attorneys to report the misconduct of other attorneys under certain conditions. Here is an excerpt:

Based on media reports, SB 42 was introduced in response to the Tom Girardi scandal that dominated legal headlines for most of 2022. However, the real issue in the Girardi scandal was not that the State Bar was unaware of the allegations of misconduct, but that it failed to investigate them adequately and detect misconduct that resulted in the loss of millions in settlement funds by Girardi’s clients. Therefore, what assurance does the public (or the profession) have that the adoption of SB 42 would deter future similar misconduct?

Further, despite the similarity to Model Rule 8.3, SB 42, as proposed, is silent regarding the challenges inherent for attorneys who want to comply with the reporting requirements of the proposed law.
