If you are the parent who has visitation rights in Alabama and you receive notice that the other parent plans to relocate with your child, you need to act immediately if you want to keep that child there.

You have the right to file an objection with the court, but it has to be filed. You cannot just notify the other parent and say you disagree — that is not good enough. You have 30 days from the day you receive the notice to file that objection, and then you have the chance to show the court why your child should not move away.

If you are concerned the custody arrangement for your child is no longer in their best interest, the very first thing you need to do is start documenting everything you can.

Keep a calendar of what is occurring in that child's life, of your time with the child, and of the other parent's time with the child. Get in touch with the teachers and counselors of the child and see if they have any concerns.

It is never too soon to start gathering evidence. And once you are convinced it is time to make a change for that child, we will file a petition to modify custody with the court.
