Montanans - I would ask that you take a closer look at what this current Republican-led legislature is doing. The spate of recent laws intentionally designed to weaken the judiciary are contrary to bedrock constitutional principals upon which the Constitution and this Country are founded. If you really consider yourself a "patriot," perhaps take a moment to reflect upon what a loss of separation of powers would actually look like. It might look a lot like a monarchy.

In the first of two articles on how bars are supporting the judiciary, we focus on recent challenges to judicial independence. The second article, in a future issue, will look at courthouse security and personal safety for judges and their families.

"When critics accuse the courts of subverting the majority will, or failing to adhere to public sentiment, that is akin to criticizing them for doing their jobs. If we had judges who put their fingers in the air to test public sentiment each time they had to make a tough decision, we would not have the rule of law—we would have a rule of men and women. That kind of decision making would be untethered to the constitution and would be corrosive."

Folks - this type of thinking is dangerous. Courts and Judges do not "adhere to public sentiment," nor should they. If the co-equal third branch of government were to become subject to "oversight from the citizens," as this group believes, it would necessarily become untethered from the Constitution. Aside from the substantive problems this Group presents, which are contrary to the Rule of Law, it appears their leader is a convicted felon who misrepresents the truth. Probably a bad idea to base policy decisions on the misguided ponderings of such a person or group.

A citizen group espousing the need for judicial integrity is backtracking claims on its website.

We all know what happens when one leg of a three-legged stool is removed. We are disappointed that many in this Republican-controlled legislature do not seem to have been taught, or ever cared to learn, basic civics.

Americans often indulge in a kind of “Salem exceptionalism,” treating the events of 1692 as if they were an isolated and idiosyncratic departure from the long arc of human affairs.
