The recent announcement by USCIS on May 22nd has caused a lost of concern and worry for individuals seeking to adjust their status in the United States to permanent residency. Please be aware that AILA, the American Immigration Lawyers Association, is working on legal action to enforce the corresponding immigration laws. In the meantime, below is general information from AILA as it is known currently. The situation is new and may change. All current affected clients have been, or will be, contacted by our attorneys. ALERT/AVISO:
Due to continued changes in interpretations of the law and a recent decision for those found present within the 5th circuit (Texas, Louisiana & Mississippi), individuals who are detained by Immigration and entered the United States without inspection (illegally) will NOT be released from ICE custody and will have no legal way to fight detention. As such, Solorio & Avila Law firm does NOT recommend any individual who does no have lawful status and did not enter the U.S. with a valid legal visa entry to travel to the states of Texas, Louisiana & Mississippi. The Courts continue to limit due process rights, and the location of an individual’s detention now affects due process rights. While the immigration attorneys continue to fight for due process rights, limited travel outside of your home area is recommended as the situation continues to change rapidly.

Debido a los continuos cambios en la interpretación de la ley y una decisión reciente, aquellos individuos que son detenidos por Inmigración y habían entrado a los EE. UU. sin inspección (ilegalmente) y que se encuentren dentro el 5to circuito (Texas, Louisiana y Mississippi) NO serán liberados de la custodia de ICE y no tendrán manera legal para pelear su detención. Por lo tanto, Solorio & Avila Law Firm NO recomienda que un individuo que no tenga estatus legal y que no entró al EE.UU con entrada valida con visa viaje a los estados de Texas, Louisiana y Mississippi. Las cortes siguen limitando los derechos de debido proceso y el lugar de donde uno es detenido por Inmigración afecta sus derechos. Mientras tanto que abogados de inmigración siguen pelando por los derechos de debido proceso, es recomendable limitar los viajes fuera de su base de hogar ya que los cambias siguen sucediendo rápidamente.

USCIS continues to announce changes to the naturalization requirements including an expansion of the good moral character requirements announced last month which now include employment history; educational attainment; family ties & family caregiving/responsibility; y compliance with tax obligations. Today, September 18, 2025, USCIS announced a new naturalization exam. Applicants have 30 days to submit applications with the old exam. Individuals who are interested in applying for naturalization are encouraged to review their eligibility under the new rules and prior to the new exam taking effect. Additional changes are expected in the future which will continue to make the naturalization process more difficult.

USCIS sigue anunciando cambios a los requisitos para la naturalización incluyendo una ampliación del requisito de buena conducta moral lo cual ahora incluye: su historial de empleo; logros educativos; lazos y responsabilidades familiares; y cumplimiento con obligaciones de impuestos. USCIS anunció hoy, el 18 de septiembre de 2025, un nuevo examen de naturalización. Solicitantes tienen 30 días para someter solicitudes con el examen anterior. Personas que están interesados en solicitar la naturalización sol alentados para revisar su elegibilidad de bajo los requisitos actuales antes de que el nuevo examen empiece. Se espera cambios adicionales en el futuro lo cual seguirá haciendo el proceso de naturalización mas difícil.

Today USCIS announced extension of TPS for Salvadorans for another 18 mos. It is recommended that all eligible TPS El Salvador holders file to renew immediately.

USCIS & Immigration Court Closures This Week:
The Kansas City Immigration Court will remain closed Tuesday 01/07/2025 due to weather conditions.

The USCIS Office & biometrics office has not yet made an announcement. USCIS office closures are here: https://www.uscis.gov/about-us/uscis-office-closings

All Federal Government office will be closed on Thursday, January 9, 2025 per an Executive Order in observance of former President Jimmy Carter’s memorial. Given this closure, appointments and hearings on January 9, 2025, will be rescheduled.
