Wilson Law Group had the privilege of going live last night on Fox 9 Minneapolis to talk about the fight against unlawful detentions. This is an important story because this fight is about protecting the very definition of personal liberty. People are always bigger than their governments, and we need to keep making sure that no one forgets this. It was also a great opportunity for a proud daughter to spend time with her dad. The Board of Immigration Appeals, ever playing the role of puppet rather than neutral arbiter of the law, reversed a key precedent today. Matter of Arrabally was a foundational decision for over two decades. It is no more. The end of Arrabally makes the usage of advance parole incredibly dangerous for anyone who is not currently maintaining a status while applying for adjustment of status. DACA beneficiaries included. Only someone who is maintaining a valid nonimmigrant status (not DACA) and will maintain his or her status upon return should even consider using advance parole. Almost no one fits this definition! Using advance parole incorrectly will trigger one, if not more than one, bars to becoming a permanent resident. IT IS A TRAP. Please reconsider any future travel plan immediately. A departure from the United States pursuant to a grant of advance parole is a “departure” within the meaning of section 212(a)(9)(B)(i)(II) of the Immigration and Nationality Act, 8 U.S.C. § 1182(a)(9)(B)(i)(II).

You have the right to a decision! The law allows a person waiting for a decision on a naturalization application to sue 120 days after the interview. Congress gave this right - use it! David Wilson participated in this story because it is important to highlight how the government is trying to restrain the voice of the community in the political process.

Just over a year ago, Minnesota regularly held large, public naturalization ceremonies, often with hundreds of people at a time. But since then, new vetting procedures by federal immigration officials have led to dwindling numbers of ceremonies and the number of people who participate in them.
