IMPORTANT IMMIGRATION ALERT FOR UKRAINIANS IN THE UNITED STATES

UKRAINE TEMPORARY PROTECTED STATUS (TPS) — EAD UPDATE

August 15, 2026

Ukrainian nationals currently protected under Temporary Protected Status (TPS) should be aware of an important update concerning their employment authorization.

CURRENT TPS END DATE: OCTOBER 19, 2026

The Temporary Protected Status designation for Ukraine and related TPS benefits are currently set to terminate on October 19, 2026.

USCIS IS EXTENDING CERTAIN EXPIRED WORK PERMITS

U.S. Citizenship and Immigration Services (USCIS) is sending individual notices to certain Ukraine TPS beneficiaries whose Employment Authorization Document (EAD) renewal applications remain pending.

The notice applies to TPS recipients who:

● continue to be eligible for TPS;
● have not yet received their renewed EAD;
● have a TPS-based Form I-765, Application for Employment Authorization, that remains pending with USCIS; and
● have an expired TPS-based EAD in category A-12 or C-19.

EMPLOYMENT AUTHORIZATION EXTENDED THROUGH OCTOBER 19, 2026

For individuals who receive this USCIS notice, their expired TPS-based EAD is extended through October 19, 2026 — the currently scheduled end of the Ukraine TPS designation.

This USCIS notice may therefore be extremely important for demonstrating continued employment authorization to an employer.

WATCH FOR YOUR USCIS NOTICE

USCIS will send these notices:

By mail to eligible Ukraine TPS recipients; and

Electronically to eligible recipients who have a myUSCIS online account.

TPS beneficiaries with pending EAD applications should carefully monitor both their mail and myUSCIS accounts and keep any USCIS notice they receive with their immigration and employment records.

IMPORTANT

Do not assume that every expired TPS EAD is automatically covered by this particular announcement. The USCIS notice concerns qualifying Ukraine TPS beneficiaries with pending TPS-based EAD applications.

Individuals should review their own EAD category, expiration date, pending I-765 application, and USCIS notices to determine how the announcement applies to their specific case.

October 19, 2026 is a critical date for Ukrainian TPS beneficiaries. Ukrainians relying on TPS should closely monitor official announcements from USCIS and the Department of Homeland Security for any further developments regarding Ukraine TPS.
