Kiel Doran secured summary judgment dismissing Plaintiff’s Labor Law claims against our clients. Kiel argued that Plaintiff was not engaged in Labor Law 240 or 241(6) protected work, that even if he was neither section applied to his accident, that the clients did not direct, supervise, or control how he performed his work so they could not be negligent for the way in which he elected to unload the truck, and finally that, because he was on his employer’s truck in the street, the clients could not be liable for any condition that caused or contributed to the accident. The court agreed with our arguments, and dismissed all claims against the clients as well as the cross and counter claims

Rachel Mahoney obtained an Order from a Judge in Supreme Bronx awarding costs and sanctions against Plaintiff's counsel for willful misrepresentations and contumacious conduct arising from prosecution of a dubious Labor Law claim involving an unwitnessed fall at a construction site. The case was also dismissed by the Court.

Partner Ed Kelly and Appellate Specialist Eric Tosca obtained a dismissal, affirmed on appeal, after a motion to dismiss a cable installer's Labor Law claims after he fell from a ladder in a Suffolk County Labor Law case. The Court held that the Plaintiff was not engaged in Labor law protected construction activities when he fell.
