When Do Police Actually Have to Read You Your Rights?

Most people have heard the famous line from TV:
"You have the right to remain silent. Anything you say can and will be used against you in a court of law."

But in real life, police don’t always have to read you your Miranda rights.

In New York—including Nassau County and across Long Island—Miranda warnings are only required when two things happen:

âś” You are in police custody
âś” Police are interrogating you

This situation is called custodial interrogation.

That means many interactions with police — including traffic stops or casual questioning — may happen without Miranda warnings, and statements you make could still be used in court.

⚠️ Even spontaneous statements can become evidence.

Knowing when your rights apply can make a major difference if you’re ever questioned by law enforcement.

In our latest article, we explain:

• When Miranda rights actually apply
• What counts as police interrogation
• Why traffic stops are different
• The public safety exception
• How a Huntley hearing can challenge statements obtained improperly

If you or someone you know is facing questioning in Nassau County or anywhere on Long Island, understanding your rights is critical.

The R.M.L. Law Firm, PLLC proudly defends clients across Nassau County, Suffolk County, Queens, and NYC.
