With 2020 behind us and 2021 before us, now is a good time to review your estate plan. Mundane yet legally important documents, i.e. healthcare proxy, power of attorney, a will, and a trust or life estate, are great and affordable instruments in preserving your wealth and passing it on to future generations.

If you are a residential tenant in New York and behind in rent payments due to COVID you now have until January 1, 2021 before you can be evicted. Now is the time to meet with an attorney and work on a strategy to work out a payment plan with your landlord.

On behalf of my law practice and myself, I thank all NUMC staff and CSEA for the hard, selfless work performed ever day and recognized specifically on Labor Day.
Remember, Labor Day is a product of that hard work. The Labor movement’s diligence in the late 19th century brought about the Federal Holiday, Labor Day, in 1894.
Moreover, that movement, vis-a-vis the movements representatives or union leaders, fought hard for fair pay, time off with pay, shorter workweeks leading to a better quality of life, healthcare, sanitary and safe work environments, and so on.
So, on this day appreciate what you do everyday. Appreciate those that got us to this point. And fight diligently to ensure the same, if not better, work environment for future union members. Happy Labor Day!!!!

The LGBTQ community has temporarily, and more likely than not permanently, won on blocking Trump’s administration from discriminating against them vis-a-vis the US Department of Health and Human Services.
A NY Southern District Judge issued a preliminary injunction blocking the US HHS from enacting new rules drafted during and after a ruling by the Supreme Court in Bostock v. Clayton, which was a 6-3 decision, thus forcing HHS to re-evaluate it’s proposed rules.

Another decision by our Supreme Court protecting rights of minorities. DACA stays in place, for now, and this is with a conservative majority! Thank you for clear, legal reasoning.

As hard as some members of our society work on limiting the rights of other members of our society, thankfully the Supreme Court of the United States, in a 6-3 decision, upheld the rights of LGBTQ against workplace discrimination.

In March of this year I posted that all healthcare professionals should keep a personal diary regarding PPE shortfalls and who, when, and what outcomes of putting management on notice regarding such. Now, several months later, one of the problems I feared is playing out in court, and is exactly why I encourage personal diaries. EMS workers and their union are suing FDNY for punishing EMS workers who spoke out regarding lack of PPE. Personal dairies will play a central role in that action.

As NYS realizes a decline in hospital and nursing home COVID cases, the unfortunate reality, based on past practices, is an increase of health care professionals being reported to the NYS Office of Professional Discipline (OPD). Should you, a friend, or family member receive a letter from OPD request a meeting with an investigator, two important points to remember: 1. You should always consult an attorney familiar with OPD before responding to their request. 2. Do not ignore the letter as doing so is another potential charge against your license.

Many lessons are gleaned from the current pandemic. One is the necessity of basic estate planning. Everyone should consider preparing a Will or trust to ensure your legacy passes to recipients of your choosing; A healthcare proxy so your medical decisions are honored and enforced if your capacity is compromised; power-of-attorney to ensure your financial affairs remain stable during an incapacitated state. The aforementioned documents are relatively inexpensive to execute and allow and ensure your decisions are honored when your voice is muted.

I am updating a post of several weeks ago: for residential and commercial property renters, our Governor extended the “no eviction” period to August 20, 2020.
Again, I caution those not able to pay rent that you should engage your landlord sooner, rather than later, to negotiate how and how long past due rent can be tendered.

Mitch McConnell suggested States should consider declaring bankruptcy instead of the Federal government designating funds for cash strapped States.
Two problems with that suggestion: 1. Federal Bankruptcy Code prohibits State Government from declaring bankruptcy, but does allow political subdivisions (municipalities for example) to do so. 2. US Constitution Contracts Clause prohibits State Government from “impairing the obligations of contracts” thus not allowing States to erase debt by bankruptcy.
