She received her bachelor's degree from the University of Wisconsin-Madison and a law degree from Chicago-Kent College of Law. Our legal assistant, Trinette Hernandez, has been with the firm since 2014. She has worked in the legal field for almost 40 years. Trinette is our first point of contact when requesting an initial consultation and provides our clients with a sympathetic ear throughout the process.

This is an important recent ruling regarding domestic violence and child custody in Wisconsin. "Under Wis. Stat. section 767.41(2)(d), there’s a presumption that joint or sole legal custody is not in the best interest of the child if the court finds that a one party has engaged in a pattern or serious incident of interspousal battery or domestic abuse." However, the court of appeals agreed with the circuit court that "the statute permits but does not mandate courts to consider domestic abuse." What this ruling meant in this particular case is that at the final divorce hearing, the wife agreed to joint custody of the parties' minor children, notwithstanding the domestic abuse she endured from her husband during her marriage. When she sought to have her divorce reopened based on the domestic abuse that occurred during her marriage (not based on new acts of domestic abuse), the court held that she had already considered the marital domestic abuse when making the decision to agree to joint custody, therefore, she could not come back now and try to get sole custody after she waived the presumption of sole legal custody on those specific acts of domestic violence that occurred during the marriage.

July 13, 2015 – A state appeals court has ruled that a spouse waived her right to invoke a presumption restricting child custody based on domestic abuse when she stipulated to joint custody of minor children in the original divorce proceedings with her husband.
