The legal framework governing the treatment of LLCs during a divorce in Milwaukee, and broadly in Wisconsin, is intricate, shaped by both statutory law and case precedents. Under this framework, if an LLC is deemed marital property—acquired or substantially grown through the efforts of either spouse during the marriage—it must be equitably divided. This equitable division does not inherently mean equal but aims for fairness, considering factors like each spouse’s contribution to the business and their economic circumstances post-divorce. Today is the 70th anniversary of the historic Brown v. Board of Education ruling which ended segregation in public schools. 70 years ago today the Supreme Court delivered its unanimous decision overturning the 1896 Plessy v. Ferguson ruling as it applied to public education and Chief Justice Earl Warren said “separate but equal” facilities violates the Equal Protection Clause of the 14th Amendment.

As lawyers we have to ask the hard questions to make sure our clients get a fair trial. "Data also revealed that relative to Black jurors, white jurors were less empathetic towards Black defendants and their families. This finding was reflected in qualitative data in which Black jurors discussed their experience during deliberations. Black jurors detailed instances where they and their white counterparts saw the evidence quite differently: For example, one Black woman described that when the Black defendant’s family members testified during the punishment phase about their love for him (the defendant), she found it to be moving and genuine testimony, while her white counterparts “didn’t believe it was real; they believed it was putting on.” In another case, a Black man pinpointed the source of this racialized divide among the jurors and how it affected the jury’s sentencing decision. He and one Black woman were the only Black people on a jury he describes as wanting to “burn both of them [the Black defendants]. … I’m serious, that’s the impression I got. … [The other jurors] didn’t give a s**t one way or the other. … [W]hat I’m saying is they had no respect for a Black male and they didn’t know how to really judge him.”

While mediation is something we strongly believe in for divorce cases there are times when it is not recommended. One of those times is where there is domestic violence or a history of it in the marriage. We discuss this in a recent article:
DOMESTIC VIOLENCE: PRIORITIZING SAFETY
Domestic violence is a serious issue that can have significant implications in divorce proceedings. In cases where there is a history of domestic abuse, mediation may not be recommended or even allowed. The power imbalance and fear of retaliation can prevent the victim from effectively advocating for their needs and interests during mediation sessions. Mediation also requires open communication and cooperation, which can be nearly impossible in cases where there is ongoing abuse.
In these situations, it is essential to prioritize the safety of the victim and their children. Seeking assistance from a domestic violence advocate or legal counsel who specializes in handling domestic violence cases may be a better option for ensuring the well-being of all parties involved.

In 1988 a coalition of Asian Pacific American bar leaders from around the country came together to create a national voice of engaged and active lawyers to support their community. Today is Law Day! The theme this year is Voices of Democracy.
“Law Day is a special day of celebration by the people of the United States in appreciation of our liberties as well as a day that seeks to cultivate respect for the rule of law that is so vital to our democratic way of life,” ABA President Mary Smith noted. “On this particular Law Day, however, we find our system of laws as well as our very democracy under great strain. Wisconsin is a “no-fault” divorce state, which means couples can file for divorce without the need to prove wrongdoing by either party, emphasizing that the marriage is irretrievably broken as the sole ground for separation. This principle streamlines the process, focusing on equitable solutions rather than assigning blame.

Wisconsin law also mandates the division of marital property equally, considering all assets acquired during the marriage as joint property unless agreed otherwise. Additionally, residency requirements stipulate that at least one spouse must have lived in the state for a minimum of six months and in the county where the filing occurs for at least 30 days before initiating the divorce. Prior to serving in congress, she was extremely active in the civil rights movement, organizing for the Student Nonviolent Coordinating Committee and chairing the Equal Employment Opportunity Commission. Are you wondering why the courts consider some things marital property and some separate property during the divorce? We discuss this and more in our newest blog post.
During divorce, the distinction between marital and separate property is often misunderstood. Marital property, generally speaking, encompasses assets and debts acquired by either spouse during the marriage, regardless of whose name is on the title. This can include everything from the family home to retirement accounts and even personal items such as furniture.
Separate property refers to assets owned by one spouse prior to the marriage or acquired through inheritance or as a gift from a third party during the marriage. However, the waters can get murky when separate property is commingled with marital assets, potentially transforming it into marital property. For example, receiving a family inheritance but then putting it in a joint bank account could change its status.
In Wisconsin, the court presumes all property is marital unless proven otherwise. Other states may have different laws, so it’s important to consult with a local divorce lawyer. Questions? Contact us at 414-287-0088.
