It’s possible to get an annulment in Maryland rather than go through a divorce, but only in very limited, specific circumstances. An annulment means your marriage never existed.

Some reasons for annulment in Maryland may include:

✅Bigamy: One partner was already married at the time of your wedding.
✅Duress or abduction: You were forced into the marriage. An example might be an arranged marriage in which you had no say.
✅Fraud: Your partner concealed crucial information. Known inability to have children would fall into this category.
✅Mental Incapacity: One of the partners was incapable to consent to the marriage. This need not be permanent incapacity and could be anything from mental illness to intoxication.
✅Incest: The partners are too closely related to be married in Maryland.
✅No consummation

To get an annulment, you must act immediately after finding out the grounds. If you don’t act immediately, particularly if you continue to live together, a court’s not going to grant you an annulment.

Just because a marriage is short does not mean a court is likely to grant an annulment. Maryland courts prefer that you go through the divorce process in all but clear-cut cases.

How can I protect my assets prior to filing for divorce in Maryland?

✔️ Make a list of all your assets and your spouse’s assets, indicating which are in your name and which are in your spouse’s name.
✔️ Get hard copies of your financial records. Your spouse could change the password on digital accounts, making it difficult for you to access them.
✔️ Determine and separate non-marital property that you brought into the marriage or inherited.
✔️ Run a credit report so you don’t have any surprises.
✔️ You may need to compromise. Decide which property you really want and what is important to you in the divorce. Know how much money you need to live comfortably.
✔️ Don’t make large purchases. That can be interpreted as dissipating assets, because you don’t want them to go to your spouse.
✔️ Consult with an experienced Maryland family law attorney. They can guide you in navigating complex issues that may include real property, retirement accounts, high-end asset division, and other issues.

Some people hold the false belief that all a parent need do to get out of paying child support is to give up their parental rights.

That is simply not the case.

You can petition the court to voluntarily give up your parental rights, but you will still owe child support in most instances.

Usually, the only time you will be relieved of your duty to pay child support is if the child is adopted. A common scenario is that a father may give up parental rights and the mother gets remarried to a man who wants to adopt the child.

You did everything right and obtained a court order for your ex to pay child support. But they just aren’t consistently paying! What to do? You have options.

Maryland CSA

The Maryland Child Support Administration (CSA) -- formerly known as Office of Child Support Enforcement “OCSE” -- can help you enforce your child support order and locate your child’s other parent for a nominal fee to open your case. They could deduct child support from the paycheck of your child’s delinquent parent, as well as their unemployment and workers’ compensation claim payment.

The downside?

The CSA is slow. If you need the money quickly, you will need to proceed with an attorney instead.

Maryland Family Law Attorney

A Maryland family law attorney can
• File a Petition for Contempt, requesting that an additional percentage be added to future child support payments to help make up for those that were unpaid.
• Petition for an earnings withholding order as well as the Petition for Contempt. It requires your ex’s employer to deduct the payment from your ex’s paycheck and send it to you.

But what if your ex doesn’t have a job or at least not one that’s on the books?
Your attorney can:
• File a motion for judgment in the amount of child support owed. After a judge grants your judgment, your attorney can take other typical actions to collect such as seizing your ex’s assets.
• Petition the court to charge your ex with contempt which can lead to jail time until they get their payments up to date.
