Boating season on Utah's lakes is in full swing โ and most people have no idea how boating accident liability actually works. Save this before you head out. ๐
5 things every boater should know:
1. Life jackets must be worn โ not just on board. Utah law requires one per person, and kids under 12 must wear theirs while underway.
2. BUI = DUI under Utah law. Same charges, same consequences. And sun, heat, and wind amplify alcohol faster than most people expect.
3. Rules vary by waterway. Speed limits and no-wake zones at Jordanelle aren't the same as Lake Powell. Check before you launch.
4. If there's an accident, stay at the scene. Leaving โ even if you weren't at fault โ is a separate offense and will hurt any legal defense.
5. Liability isn't always obvious. The operator, the boat owner, the rental company, or a manufacturer may all share responsibility. Even if the operator was a friend or family member, their policy likely covers passenger injuries.
