📚 Financial Disclosures in Divorce — What the Law Requires Both Spouses to Reveal

Here is something your spouse is counting on you NOT knowing:

In a divorce, both spouses are legally required to fully and honestly disclose every asset, every debt, every source of income, and every expense.

Every. Single. One.

And if they lie? There are serious legal consequences.

📋 WHAT MUST BE DISCLOSED:

💰 Income — ALL sources:

• ✅ Salary and wages

• ✅ Bonuses and commissions

• ✅ Self-employment and business income

• ✅ Rental income

• ✅ Investment dividends and interest

• ✅ Retirement and pension income

🏦 Assets — Everything of value:

• ✅ Bank and savings accounts

• ✅ Retirement accounts — 401(k), IRA, pension plans

• ✅ Investment and brokerage accounts

• ✅ Real estate — primary home, rental properties, vacation homes

• ✅ Business interests and partnerships

• ✅ Vehicles, boats, and recreational property

• ✅ Life insurance with cash value

• ✅ Valuable personal property — jewelry, art, collectibles

💳 Debts — All liabilities:

• ✅ Mortgages

• ✅ Car loans

• ✅ Credit card balances

• ✅ Student loans

• ✅ Personal loans

• ✅ Business debts

📌 WHY THIS MATTERS:
Financial disclosures are the legal foundation for EVERYTHING in your divorce — property division, alimony, and child support are all calculated based on what is disclosed. If your spouse hides assets, you could walk away with far less than you are legally entitled to.

🚨 RED FLAGS YOUR SPOUSE MAY BE HIDING ASSETS:

• 🔴 Sudden "loans" to friends or family members

• 🔴 Income that seems lower than usual on tax returns

• 🔴 Newly discovered debts you knew nothing about

• 🔴 Deferred bonuses or delayed business income

• 🔴 Large unexplained cash withdrawals

• 🔴 Business expenses that seem inflated or unusual

⚖️ WHAT HAPPENS IF YOUR SPOUSE LIES?

• 📌 The court can impose serious sanctions

• 📌 A judge can draw an adverse inference — assuming the hidden assets exist and ruling against your spouse

• 📌 Your spouse can be held in contempt of court

• 📌 In serious cases, hiding assets can result in criminal charges for perjury or fraud

🛡️ WHAT YOU CAN DO:

• ✅ Gather financial documents NOW — before you file or before your spouse does

• ✅ Request at least 3 to 5 years of tax returns

• ✅ Pull bank, credit card, and retirement account statements

• ✅ Ask your attorney about the discovery process — interrogatories, depositions, and subpoenas

• ✅ If you suspect hidden assets, a forensic accountant can be a powerful ally

💙 Knowledge is your most powerful asset in this process. Do not sign anything and do not settle anything until you know the full financial picture.

📚 Alimony — What Every Woman Needs to Know Before Her Divorce Is Final

There is one question I hear more than almost any other:

"Am I entitled to alimony?"

📌 Alimony (also called spousal support or spousal maintenance) is financial support paid by one spouse to the other after divorce. It exists to ensure that neither spouse suffers an unfair financial hardship as a result of the divorce.

And no — it is not automatic. You have to ask for it.

💰 TYPES OF ALIMONY:
✅ Temporary Alimony — Paid during the divorce process to maintain the marital standard of living
✅ Rehabilitative Alimony — Paid while you gain education or job skills to become self-supporting
✅ Durational Alimony — Paid for a set period, often tied to the length of the marriage
✅ Permanent / Long-Term Alimony — Paid indefinitely, typically in long marriages where self-support is not realistic
✅ Reimbursement Alimony — Compensates a spouse who financially supported the other's education or career advancement

⚖️ WHAT DO COURTS CONSIDER?
📌 The length of your marriage
📌 The standard of living established during the marriage
📌 Each spouse's income, assets, and earning capacity
📌 Your age and physical and emotional health
📌 Career sacrifices made for the family or for your spouse's career
📌 Whether you left the workforce to raise children
📌 Whether you supported your spouse through school or a career change
📌 Each spouse's contribution to the marriage — including homemaking

💙 If you stayed home to raise your children, supported your spouse's education, or stepped away from your own career for your family — you may have a strong claim for alimony. The court recognizes these sacrifices. Do not walk away without exploring every option available to you.

🚨 IMPORTANT: Alimony is NOT automatic. If you do not ask for it — and fight for it — you may lose your right to it entirely.

📚 Equitable Distribution — What Every Woman Needs to Know Before Her Divorce Is Final

If you are going through a divorce, you need to understand these three words:

Equitable. Does. Not. Mean. Equal.

📌 Equitable distribution is the law in 41 states — if you live in one of them, this applies to YOU.

🔑 What Is Equitable Distribution?
The legal process in most states for dividing marital assets and debts between spouses. The goal is a FAIR division — not necessarily a 50/50 split. The court looks at the full picture of your marriage to determine what is fair for both parties.

🏠 MARITAL ASSETS — Divided:
✅ The family home
✅ Retirement accounts and pension plans
✅ Savings and investment accounts
✅ Business interests built during the marriage
✅ Vehicles, furniture, and personal property
✅ Marital debts

🚫 SEPARATE ASSETS — Generally NOT divided:
🚫 Property you owned before the marriage
🚫 Inheritances received in your name only
🚫 Gifts given specifically to you

⚖️ What Factors Does the Court Consider?
📌 The length of your marriage
📌 Each spouse's financial situation and earning capacity
📌 Contributions to the marriage — including homemaking and raising children
📌 Whether one spouse sacrificed career opportunities for the family
📌 Any interruption of education or career due to the marriage
📌 Whether either spouse wasted or hid marital assets

💙 If you stayed home to raise your children, supported your spouse's career, or put your own professional growth on hold for your family — the court recognizes that. Those contributions have real legal value. Do not walk away from what you are rightfully entitled to.

💙 Dear Woman in the Middle of Divorce,

I see you.

I see the nights you couldn't sleep, running through every conversation, every decision, wondering where it all went wrong.

I see the mornings you got up anyway — made breakfast, got the kids ready, showed up — even when everything inside you felt like it was falling apart.

I see the version of you that stayed too long because you believed in your vows. And I see the version of you who finally said: enough.

You didn't lose this marriage.

You chose yourself. Maybe for the first time in a very long time.

That is not weakness. That is the bravest thing a woman can do.

Here is what I want you to know after 30 years of sitting across the table from women just like you:

✨ The fear you feel right now is real — and it will not last forever.
✨ The life waiting on the other side of this is more than you can currently imagine.
✨ You are not starting over. You are starting from experience, from wisdom, from knowing exactly what you will never accept again.

The woman you are becoming? She is worth every hard day you are living through right now.

💙 Rise up, Ada

10/12/2026

💙 After 30 years in family law, I can tell you this: the single question I was asked most often by mothers in my office was "Will I lose my kids?"

The answer almost always surprised them.

Here is what courts actually look at when deciding child custody — and what most people get completely wrong.

The court does not automatically favor the mother.
Family courts in Florida — and most states — operate under the presumption that children benefit from having both parents actively involved in their lives. The goal is not to determine who "wins" the children. It is to determine what arrangement serves the children's best interests.

What judges actually evaluate:

✅ Which parent has been the primary caregiver day to day — who takes the kids to school, doctors, activities?
✅ The quality of each parent's relationship with the children — not just time spent, but the depth of that bond
✅ Each parent's ability to support the child's relationship with the other parent — a parent who undermines the other is viewed unfavorably
✅ The child's adjustment to their current home, school, and community
✅ Each parent's mental and physical health as it affects their ability to parent
✅ Any history of domestic violence, substance abuse, or neglect — these are heavily weighted
✅ For older children — the child's own expressed preference (though this is not the deciding factor)

What does NOT automatically win you custody:
❌ Being the higher-earning parent
❌ Buying more for the children
❌ Having a bigger home
❌ Filing first

The parent who shows up consistently, prioritizes the children's wellbeing, and supports a healthy relationship with the other parent — that is the parent courts remember.

💙 Knowledge is your best protection.

💙 I want to say something to every woman who is standing at the end of her marriage wondering how she got here — and what comes next.

You are not starting over.

You are starting from everything you have already survived. From every hard conversation you navigated. From every document you gathered, every question you asked, every morning you got out of bed when it felt impossible to do so.

That is not starting over. That is starting from a place of hard-won wisdom that most people never have.

Here is what I want you to know:

The woman who walks out of a divorce is not the same woman who walked in. She is more resilient. More clear-eyed. More certain of what she will and will not accept. More aware of her own strength than she has ever been in her life.

The next chapter does not have to be smaller than the one before. It just has to be yours. 💙

What does your next chapter look like? You get to decide that now.

👇 What is the one thing — big or small — that you are most looking forward to in your next chapter? Tell me below. I read every single comment.

💙 After 30 years in family law, I saw these same five mistakes over and over again. Knowing them in advance could save you thousands of dollars — and years of regret.

Mistake #1 — Keeping the house without running the numbers first.
The marital home is almost always the most emotionally charged asset in a divorce. But a house comes with a mortgage, property taxes, maintenance, and insurance. Before you fight for it, make sure you can actually afford to keep it — alone — on your income. Many women win the house and lose their financial stability within two years.

Mistake #2 — Overlooking retirement accounts.
A 401(k) or pension accumulated during a marriage is a marital asset. It is subject to division. Women routinely trade away retirement funds they are legally entitled to because they do not know to ask about them. Ask. Every time.

Mistake #3 — Agreeing to keep joint debt without protecting yourself in writing.
If his name is also on that debt and he stops paying — your credit takes the hit. A divorce decree does not override a creditor. Get ironclad protections built into your settlement.

Mistake #4 — Settling because you are exhausted.
Divorce fatigue is real. Attorneys know it. The other side counts on it. A settlement signed out of exhaustion is still a legally binding contract. Take the time you need to make decisions you can live with for the next 20 years.

Mistake #5 — Not accounting for taxes.
The structure of how assets are distributed has major tax consequences. A $200,000 investment account and a $200,000 retirement account are not worth the same amount after taxes. Always — always — account for taxes before you sign.

Knowledge is your most powerful asset at that table. 💙

👇 Which of these mistakes have you seen — or experienced yourself? Share in the comments. Your story could protect another woman from making the same one.

💙 Before you file a single piece of paperwork — gather these 5 documents first.

Most women wait until their attorney asks for them. The women who walk away with the best outcomes have them ready before the first meeting.

Here is what you need:

1️⃣ Three to five years of tax returns
Joint tax returns reveal the full picture of marital income — including income sources your spouse may not have mentioned. Do not skip years.

2️⃣ All bank and investment account statements
Every account — checking, savings, money market, brokerage. Go back at least two years. Transfers and withdrawals made in the months leading up to a divorce filing tell a very important story.

3️⃣ Mortgage documents and property deeds
Every property your name is — or is not — on. The deed and the mortgage statement are not always the same document and they do not always say the same thing.

4️⃣ Every retirement account statement
Your 401(k), his 401(k), IRAs, pensions, and any deferred compensation plans. Retirement accounts are among the most valuable and most frequently overlooked marital assets. Get every statement you can access now.

5️⃣ All credit card and loan statements
Marital debt is divided in divorce just as marital assets are. Know exactly what debt exists — including accounts you may not have known about.

Knowledge is your greatest protection. 💙

💰 How to identify ALL marital assets — including the ones your husband's attorney is already counting on you to overlook

🏥 What happens to your health insurance the moment your divorce is final — and how to protect yourself before that day comes

⚖️ How to tell the difference between a settlement and a genuinely FAIR settlement

💪 The financial steps every woman should take in the first 30 days after her divorce is final

This is 30 years of experience in a guide you can read in one sitting.
