A fence may separate two properties, but it does not necessarily establish the legal boundary between them.

Depending on the condominium's Declaration, Florida law, and the specific facts, responsibility could rest with:

The upstairs unit owner.
The condominium association.

Every eviction begins with the landlord serving the required notice and, if necessary, filing an eviction lawsuit.

From there, the case can take one of two paths.

An uncontested eviction occurs when the tenant does not file a timely legal response. Because the tenant has not contested the lawsuit, the landlord may generally proceed by seeking a default judgment, allowing the case to move through the court process more efficiently than a contested eviction.

A contested eviction occurs when the tenant files a response disputing the landlord's claims. In Florida, a tenant who contests an eviction for nonpayment of rent must generally deposit the rent alleged in the complaint into the court registry or file a motion asking the court to determine the correct amount of rent. If the tenant fails to do so, the landlord may be entitled to an immediate default for possession. If those requirements are met, the case proceeds through the litigation process, which may include motions, hearings, mediation, discovery, or trial before the court determines whether the landlord is entitled to possession.

Whether an eviction is contested or uncontested, complying with Florida's procedural requirements is essential to protecting your rights and avoiding unnecessary delays.
