Ocurre con más frecuencia de lo que la gente cree: un socio, amigo o colaborador le convence de transferir una propiedad a su nombre, presentándolo como una ventaja fiscal, una estructura más segura o un paso necesario para concretar un negocio. La transferencia se realiza correctamente, el título de propiedad es válido y, sobre el papel, todo parece estar en orden.

Hasta que la relación se rompe.

De repente, la persona que figura como titular reclama la plena propiedad, a pesar de que usted financió la compra, pagó la hipoteca, cubrió los impuestos y se encargó del mantenimiento de la propiedad. En ese momento, muchos asumen que no existe recurso legal alguno, pero eso no siempre es cierto.

Según la ley de Florida, los tribunales reconocen reclamaciones tales como el “fideicomiso constructivo” (*constructive trust*), diseñado para abordar situaciones en las que la propiedad fue transferida basándose en declaraciones falsas o en un abuso de confianza. It happens more often than people think: a partner, friend, or associate convinces you to transfer property into their name—framed as a tax advantage, a safer structure, or a necessary step for the deal. The transfer is done properly, the title is valid, and on paper, everything checks out.

Until the relationship breaks down.

Suddenly, the person on title claims full ownership, even though you funded the purchase, paid the mortgage, covered the taxes, and maintained the property. At that point, many assume there is no recourse, but that’s not always true.

Under Florida law, courts recognize claims such as a constructive trust, designed to address situations where property was transferred based on misrepresentation or abuse of trust. In the right circumstances, the law can require the title holder to account for your financial contributions and restore what is rightfully yours.

The takeaway is simple: title is critical, but it is not always the final word.
