𝐌𝐢𝐚𝐦𝐢 𝐏𝐚𝐫𝐭𝐧𝐞𝐫, 𝐍𝐢𝐱𝐨𝐧 𝐀𝐥𝐜𝐚𝐧𝐭𝐚𝐫𝐚, 𝐚𝐧𝐝 𝐀𝐬𝐬𝐨𝐜𝐢𝐚𝐭𝐞, 𝐕𝐚𝐥𝐞𝐫𝐢𝐚 𝐀. 𝐒𝐨𝐬𝐚 successfully obtained an order granting Defendant’s Motion to Dismiss in Lee County. Plaintiff’s Complaint was based on an Assignment of Benefits (“AOB”) that failed to comply with the requirements of Florida Statute § 627.7152(2)(a), including the mandatory indemnification and hold-harmless provision under § 627.7152(2)(a)(7) and the requirement for a written, itemized, per-unit cost estimate under § 627.7152(2)(a)(4). Associate Krystopher Uptgrow drafted the Motion, and Valeria A. Sosa successfully argued it, resulting in the Court granting Defendant’s Motion to Dismiss without prejudice and without leave to amend.

𝐎𝐫𝐥𝐚𝐧𝐝𝐨 𝐏𝐚𝐫𝐭𝐧𝐞𝐫, 𝐌𝐢𝐜𝐡𝐚𝐞𝐥 𝐉. 𝐆𝐫𝐞𝐞𝐧𝐞, 𝐚𝐧𝐝 𝐀𝐬𝐬𝐨𝐜𝐢𝐚𝐭𝐞, 𝐀𝐥𝐥𝐢𝐬𝐨𝐧 𝐍. 𝐆𝐢𝐥𝐥𝐢𝐤𝐢𝐧 of our Orlando, First-Party Property Division obtained a walk-away in a highly contested Hurricane Idalia claim where the Plaintiff was seeking over $60,000. She alleged she suffered roof damage, which required a full roof replacement. In addition, the alleged roof damage caused a peril created opening leading to interior damage. However, our position was that the alleged damages were the result of normal wear and tear and the deterioration of an aging roofing system. In addition, there were no peril-created openings that allowed water to damage the interior of the property. We filed a Motion for Summary Judgment after diligently investigating this matter. Before the deadline to respond to our Motion for Summary Judgment, Plaintiff no longer wanted to pursue the subject claim and agreed to file a Voluntary Dismissal with Prejudice if we did not pursue fees and costs associated with our expired Proposal for Settlement.
