The median income figures adjust periodically to reflect economic changes. For cases filed between April 1, 2026, and July 14, 2026, Florida’s means test thresholds are:

👨 Single individual: $69,876
👫 Two-person household: $86,523
👪 Three-person household: $97,540
👫👧👶Four-person household: $114,761

Can I Keep My House If I File for Bankruptcy in Florida?🏠

For many Florida families, one of the greatest concerns when considering bankruptcy is protecting the residence. Fortunately, filing Chapter 13 does not automatically put your home at risk. Whether you can keep it depends on several factors, including your mortgage status, available equity, the chapter you choose and whether the home qualifies under Florida’s homestead exemption.

Find out how Florida’s homestead exemption protects your equity. https://www.miamibankruptcy.com/blog/2026/08/can-i-keep-my-house-if-i-file-for-bankruptcy-in-florida-3/

Florida Leads the Nation in Foreclosure Filings, according to the property data company, ATTOM. https://timothykingcade.com/2026/08/11/florida-leads-the-nation-in-foreclosure-filings/

When Can a Foreclosure Start in Florida?

Foreclosure generally cannot begin until a homeowner is more than 120 days behind on mortgage payments. This period gives the homeowner time to submit a loss mitigation application before the foreclosure process starts. Additionally, almost all mortgages in the state of Florida have the right of “reinstatement.” This means that, if at any time during the foreclosure litigation process the borrower comes up with the money for the late payments or can make a deal with the bank to cure the arrearages or late payments, legally the bank must dismiss the foreclosure action.

If you cannot make your monthly mortgage payments, you have options available to you that can keep you from losing your home.

📢 REMEMBER: In Florida, the homeowner has rights when it comes to foreclosure! But do not delay.

🏠 Choosing the right attorney can make the difference between keeping your home or losing it in foreclosure. A well-qualified Miami foreclosure defense attorney will not only help you keep your home, but they will be able to negotiate a loan that has payments you can afford. Do not wait to speak with a trusted, aggressive client advocate who can help you in your effort to save your house. Contact our law office for a free consultation.
