Important update for F-1 students:

A federal court has blocked the new DHS rule that would have replaced Duration of Status (D/S) with fixed admission periods.

For now, F-1 students remain under the current D/S framework. No change. No new fixed expiration date.

This is a preliminary injunction, and litigation continues. We will keep you updated as this develops.

EB-1C is one of those categories where the organizational chart only tells half the story.

The real case is in the details: who makes the decisions, who has authority, how the U.S. and foreign companies operate together, and whether the position is truly executive or managerial in practice.

This one came together exactly as it should.

BREAKING NEWS: I-864 Changes Effective August 31, 2026

• USCIS will no longer accept the 10/17/24 edition of Form I-864.

• Sponsors must use the new 08/24/26 edition. There is no grace period.

• The new form authorizes USCIS and DOS to obtain information from consumer reporting agencies, including credit reports and credit scores.

• USCIS may use this information to verify a sponsor’s financial information and assess the sufficiency of the Affidavit of Support.

• Sponsors with a credit freeze may experience delays if USCIS cannot access the information it needs.

• Forms I-864A and I-864EZ have also been updated.

• USCIS has not announced a minimum credit score or explained exactly how credit history will affect I-864 determinations.

Important: Meeting the income requirement remains necessary. The new credit provisions add another financial-information component to the sponsorship process.

MAJOR IMMIGRATION UPDATE

On August 21, 2026, a federal judge in CLINIC v. Rubio struck down the State Department’s 75-country immigrant visa pause.

WHAT THIS MEANS:

• The 75-country visa pause has been vacated.
• Visa refusals based solely on this policy have also been vacated.
• Affected cases can return to the consulates for further processing.

IMPORTANT : This does not mean automatic visa approval. Each case must still meet all normal immigration requirements.

The government may appeal or seek a stay. For now, this is a major positive development for families and applicants affected by the pause.

🚨Important immigration update: A new BIA decision may affect people traveling outside the United States with Advance Parole.
As of Aug. 13, 2026, leaving the United States with Advance Parole may still count as a “departure” for certain unlawful presence bars.

People who have more than 180 days of unlawful presence could face a 3-year or 10-year bar when trying to return.
