Detener inmigrantes sin una orden judicial válida no es “aplicación de la ley”. Es una práctica ilegal y profundamente preocupante.

Las órdenes administrativas emitidas por la misma agencia que detiene no cumplen con el requisito constitucional de causa probable. La Constitución exige un funcionario judicial independiente.

Cuando el gobierno actúa como investigador, acusador y juez al mismo tiempo, el Estado de Derecho se rompe.
Nadie —y menos un niño— debe ser privado de su libertad sin debido proceso.

Detaining immigrants without a valid judicial warrant is not “law enforcement.” It is an unlawful and deeply troubling practice.

Administrative warrants issued by the same executive agency that conducts the arrest do not meet the constitutional requirement of probable cause. The Constitution requires review by an independent judicial officer.

When the government acts as investigator, prosecutor, and judge all at once, the rule of law collapses.
No one — especially a child — should be deprived of liberty without due process.
