As the practice becomes more common, he noted that clear, uniform rules will be essential to protect attorney-client privilege while maintaining transparency in civil litigation.

Jason highlighted how TPLF can “democratize litigation,” giving lower-income plaintiffs a chance to challenge well-funded defendants. He also stressed the importance of clear guardrails as Florida considers future regulations.

While proposed TPLF legislation stalled this session, Jason made it clear in the article that regulation in Florida is only a matter of time. “It’s going to pass in the future at some point,” he said. “Florida is going to lean into this.”
