Employers can sponsor employees for U.S. permanent resident status through different employment-based immigrant visa categories.

Here is an explanation of each category:

EB-1 - Priority Workers:
- Individuals with extraordinary ability in sciences, arts, education, business, or athletics.
- Outstanding professors and researchers.
- Multinational executives and managers.

EB-2 - Professionals With Advanced Degrees or Exceptional Ability:
- Individuals with exceptional ability in sciences, arts, or business, who will significantly benefit the national economy, cultural, or educational interests or welfare of the United States.
- Individuals who hold advanced degrees or their equivalent in specific professions.

EB-3 - Professional or Skilled Workers:
- Professionals with a baccalaureate degree.
- Individuals capable of performing skilled labor (requiring at least 2 years of training or experience) where qualified U.S. workers are unavailable.
- Individuals capable of performing unskilled labor where qualified U.S. workers are unavailable.

These categories provide employers with different options for sponsoring employees for U.S. permanent resident status based on the employee's qualifications and the needs of the company.

Obtaining Asylum in the United States

To be eligible for asylum in the United States, a person must meet the definition of a refugee as established in the Immigration and Naturalization Act. This involves having a fear of persecution based on race, religion, nationality, political opinion, or social group. The asylum process consists of two pathways: the affirmative and the defensive processes.

Affirmative Process

In the affirmative asylum process, individuals must be physically present in the United States or along the border at any port of entry. Regardless of how they arrived in the US or their current immigration status, people can apply for asylum. This requires submitting a Form I-589, Application for Asylum and for Withholding of Removal, to US Citizenship and Immigration Services (USCIS). Applicants must apply for asylum within one year of their last arrival in the US, unless they can show changed circumstances or extraordinary circumstances causing a delay in filing. Once the application is accepted, applicants will go through security vetting, receive a notice of receipt, and be scheduled for a biometrics services appointment. They will then attend an interview where they demonstrate credible fear for their safety if removed from the US. The entire process usually takes about six months. If the application is not approved by USCIS, the applicant can re-apply using the defensive process. For a more detailed look at the affirmative process, please see USCIS website.

Defensive Process

The defensive process is available to asylum seekers who were denied in the affirmative process or have been detained for removal by Immigration and Customs Enforcement (ICE) or Customs and Border Protection (CBP). This process operates within immigration courts, where the judge listens to the asylum seeker, their attorney (if accessible), and the government representative from ICE. If the judge deems the applicant eligible, asylum will be granted. If found ineligible, the judge will consider other forms of relief from removal based on the criteria.
