TRICK: Watchout for tricks in settlement negotiations such as "Rolling Concessions" they are used to gain additional concessions from the fatigued or careless party. When an agreement seems near you will hear phrases such as "We are almost there, if we can just agree on this last item ..." The fatigued or careless party is tempted to get deal done but once agreed the other party then says: "that is great but, there’s just one small thing we need to sort out and we are done." They ask for another concession and so on. Each concession appears to be the last and the fatigued or careless party may make the concessions just to get it done!
