The law created privilege for a reason.

Attorney client. Spousal. Priest penitent. Therapist. All of it exists because society decided certain conversations need to be protected to happen honestly at all.

The linchpin is the expectation of confidentiality.

And that's exactly what's missing with AI chatbots. Talking to ChatGPT is not like talking to your therapist. It's closer to taking advice from a stranger at a coffee shop who happens to be really good at listening.

The expectation of privacy isn't there. And legally, that changes everything.

From the moment you wake up, you're generating discoverable evidence.

Social media. Email. Text. WhatsApp. Every message across every platform is fair game in litigation.

Now add AI chatbots to that list. People are using them for parenting advice, health record analysis, things they'd never say out loud in a deposition. Sam Altman said it himself: he doesn't understand why people are oversharing with chatbots. None of it is guaranteed to be private.

Where does discovery end and personal diary begin? That line is being drawn right now.

Every episode finds its way back to AI. That's not a coincidence. It's a signal.

Legal has the biggest gap of any industry between what AI is capable of and how much it's actually being used. The technology is there. The adoption isn't.

One firm built bespoke AI tools in house. The partner who was skeptical at first now can't imagine practicing without it.

The takeaway is simple: if you're running a law firm and not thinking about how AI fits into your practice over the next few years, you might not be running a law firm for long.

Judges are human. They bring bias, experience, and prior judgment into the courtroom. That's not a criticism. That's just true.

The system already knows this. That's why there are two levels of appeal. It was built to account for human imperfection, not eliminate it.

The real question is whether we actually want to take that humanity out of the courtroom. And the answer might be no.

Not using AI as a lawyer is becoming a malpractice question.

If a client finds out their lawyer is skipping tools that would save time and sharpen the work, that's not a preference. That's a problem.

The comparison says it all: one day certifying you used AI will be like certifying you used a computer to draft the brief. Nobody questions it. Everyone does it. It's just the standard.

The lawyers treating it as optional right now are the ones who are going to have to answer for it later.

In 1933, a man named Giuseppe Zangara tried to assassinate Franklin Roosevelt in Miami.

He was 5 feet tall. Couldn't see over the crowd. So he stood on a chair to get his shot. Fired every round. Missed Roosevelt entirely. Hit everyone else. The mayor of Chicago, the wife of the President of Florida Power and Light, a retired police officer.

He was brought into this exact courtroom. Pled guilty. No trial needed.

Within five weeks he was executed. His last words: "push the button."

One of the swiftest executions of the 20th century. Judge Scott Silverman tells the story from the room where it happened.
