Puedes hacer todo bien esta semana y aun así quedarte sin permiso de trabajo.

El 15 de septiembre USCIS cambia de edición el Formulario I-765 (permiso de trabajo) y el I-539 (extender o cambiar estatus). El 18 cambia el I-485 (la solicitud de green card). USCIS dice por escrito que no hay periodo de gracia.

Lo que eso significa, en palabras de la agencia:

→ Una edición vieja "con matasellos o enviada electrónicamente en la fecha o después" se rechaza.
→ La edición nueva tampoco se acepta antes de la fecha: "No presente las ediciones 09/15/26 de estos formularios antes del 15 de septiembre de 2026."
→ La fecha que cuenta es el matasellos — o el clic — no el día que firmaste.

Por qué un rechazo es peor que una negación: una negación es una decisión que puedes pelear. Un rechazo es un paquete que regresa semanas después sin nada en el expediente — y tu fecha de presentación se va con él. Para una renovación de permiso de trabajo puede ser un hueco sin extensión automática. Para una green card puede ser perder el mes en que tu categoría estaba abierta.

Cuatro revisiones antes de cerrar el sobre:
1. Lee la fecha de edición — abajo a la izquierda de la página 1. 09/15/26 para I-765 e I-539, 09/18/26 para I-485.
2. Escoge tu lado de la fecha. ¿Envías antes? Edición vieja, con matasellos antes. ¿En la fecha o después? Descarga la nueva ese día.
3. Presenta en línea donde se pueda. Una hora exacta es una fecha que puedes probar.
4. No firmes hoy un paquete que va a cruzar la fecha en el correo.

La única excepción: el Formulario I-864 (Declaración de Apoyo) recibió 30 días de gracia — la edición vieja se acepta hasta el 30 de septiembre.

Puedes aprobar el examen de educación cívica y aún así que te nieguen la ciudadanía.

La entrevista no es solo el examen. El oficial revisa tu solicitud completa: tus viajes, tus impuestos, las direcciones donde has vivido, tu historial de empleo y las respuestas que diste en solicitudes anteriores. Está verificando todo contra lo que el gobierno ya tiene.

Sabes quién fue el primer Presidente. Sabes cuántos estados hay. Eso no es lo que decide tu caso.

Una persona puede pasar el examen de educación cívica y aún así tener problemas si su solicitud los tiene.

Estudia el examen, sí. Pero lee tu propio N-400 como lo va a leer el oficial.

Do everything right this week and you can still lose your work permit.

On September 15, USCIS switches editions of Form I-765 (work permit) and Form I-539 (extend or change status). On September 18 it switches Form I-485 (the green card application). USCIS says in writing there is no grace period.

What that means, in the agency's own words:

→ An old edition "postmarked or electronically submitted on or after" the date is rejected.
→ The new edition is not accepted before the date either: "Do not file the 09/15/26 editions of these forms before Sept. 15, 2026."
→ The date that counts is the postmark — or the click — not the day you signed.

Why a rejection is worse than a denial: a denial is a decision you can fight. A rejection is a packet coming back weeks later with nothing on the record — and your filing date gone with it. For a work-permit renewal that can mean a gap with no automatic extension to cover it. For a green card application it can mean missing the month your category was open.

Four checks before you seal the envelope:
1. Read the edition date — bottom-left of page 1. 09/15/26 for I-765 and I-539, 09/18/26 for I-485.
2. Pick your side of the date. Mailing before it? Old edition, postmarked before. On or after? Download the new one that day.
3. File online where you can. A timestamp is a date you can prove.
4. Do not pre-sign a packet that will cross the date in the mail.

The one exception: Form I-864 (Affidavit of Support) got a 30-day grace period — old edition accepted through September 30.

A judge can order you deported while your chair sits empty. It's called an in-absentia order of removal, and it happens more than people think.

Three ways it happens: the hearing notice goes to an address you moved out of. A lawyer files, disappears, and never explains what arrived. Or you miss one date and assume the case went quiet — it didn't.

Years can pass with that order sitting on your record. Most people find out when somebody else finds it first.

If you never received real notice, there may be a way to ask the court to reopen. That's a real motion with real deadlines, not a formality — and the sooner it's filed, the better it reads.

El 31 de agosto USCIS publicó una edición nueva del Formulario I-864 — la Declaración de Apoyo Económico que firma todo patrocinador familiar. Encima de la firma del patrocinador ahora hay un párrafo que antes no existía.

Autoriza a USCIS y al Departamento de Estado a pedir información a "una o más agencias de informes del consumidor… incluidos informes y puntajes de crédito, en relación con la determinación de suficiencia de mi Formulario I-864." Y autoriza que lo que encuentren se le muestre al inmigrante patrocinado.

¿El crédito de quién? Del patrocinador. Si pediste a tu esposo, a tu madre o a tu hijo — o firmas como patrocinador conjunto para la familia de alguien más — es tu informe y tu puntaje.

Lo que sabemos y lo que no:

→ La prueba no cambió. La declaración sigue preguntando si el patrocinador puede mantener al familiar al nivel que exige la ley. El párrafo nuevo deja que la agencia responda también con tu historial de crédito.

→ USCIS no ha publicado ningún puntaje mínimo ni ninguna regla de cómo pesa un puntaje. Quien te diga "un mal puntaje es una negación" está adivinando.

→ Lo que USCIS SÍ dijo: si el patrocinador tiene un congelamiento de crédito o de seguridad, la agencia "quizá no pueda acceder a la información necesaria para evaluar la suficiencia del Formulario I-864," y el patrocinador "debe responder con rapidez a cualquier solicitud" de levantarlo. Un archivo congelado es una demora — y la demora te la cargan a ti.

→ Fechas: hasta el 30 de septiembre se presenta cualquiera de las dos ediciones. Desde el 1 de octubre, solo la edición 08/24/26. Una edición vieja con matasellos o envío electrónico del 1 de octubre en adelante no se procesa — y el I-485 se trata como evidencia faltante, que termina en una solicitud de evidencia o en una negación.

Antes de firmar: pide tu propio informe, corrige errores, anota si hay congelamiento, y decide si un patrocinador conjunto es la firma más segura.

Tráenos tus documentos de ingreso y dinos si tu crédito está congelado. Te decimos si eres el patrocinador correcto, si necesitas uno conjunto, y qué edición va en tu expediente. (305) 419-0105

On August 31, USCIS published a new edition of Form I-864 — the Affidavit of Support every family sponsor signs. Above the sponsor's signature line there is now a paragraph that was not there before.

It authorizes USCIS and the State Department to request "information from one or more consumer reporting agencies… including credit reports and scores, in connection with the sufficiency determination of my Form I-864." And it authorizes them to disclose what they find to the immigrant being sponsored.

Whose credit? The sponsor's. If you filed for your spouse, your parent or your child — or you are signing as a joint sponsor for someone else's family — this is your report and your score.

What we know and what we don't:

→ The test has not changed. The affidavit still asks whether the sponsor can support the relative at the level the law requires. The new paragraph lets the agency answer that with your credit history too.

→ USCIS has published no minimum score and no rule on how a score is weighed. Anyone telling you "a bad score means denial" is guessing.

→ USCIS HAS said this: if a sponsor has a credit or security freeze, the agency "may not be able to access the information necessary to assess the sufficiency of Form I-864," and sponsors "should expeditiously respond to any requests made to release" it. A frozen file is a delay — and the delay is on you.

→ Dates: through September 30 either edition of the form files. From October 1, only the 08/24/26 edition. An old edition postmarked or e-filed October 1 or later is not processed — and the I-485 gets treated as missing evidence, which ends in an RFE or a denial.

Before you sign: pull your own report, fix errors, note any freeze, and decide whether a joint sponsor is the safer signature.

USCIS now takes certain green card applications online. That sounds simple until you file it yourself.

Online filing doesn't always let the petition and the green card application go in together. File the petition alone and the green card becomes a second filing later — a second set of evidence, a second deadline, and months you didn't plan for.

Done right, online filing is genuinely better: your documents go straight into a USCIS account, the case is trackable, and a missing document gets caught before USCIS catches it.

Whether your case qualifies for online filing — and whether it goes in as one filing or two — is worth asking before you upload anything.

El 15 de septiembre se acaba el "duration of status". Por primera vez desde 1978, el estatus de un estudiante en EE.UU. va a tener fecha final.

La regla final de DHS (91 FR 44976) cambia cómo se admite a estudiantes F, visitantes de intercambio J y prensa extranjera I: ya no "mientras estés en la escuela", sino hasta una fecha — la fecha final del programa en tu I-20 o DS-2019, con tope de cuatro años, más 30 días para salir.

Lo que significa, porque ahí — entre el titular y tus propios papeles — es donde las familias salen lastimadas:

→ ¿Ya estás aquí? Conservas la fecha de tu I-20, pero te ponen un techo: 14 de noviembre de 2030 para estudiantes F, 15 de octubre de 2030 para intercambio J. Nada más allá sin una solicitud.

→ ¿Necesitas más tiempo para terminar, para OPT o para un programa nuevo? Presenta el formulario I-539 con USCIS ANTES de tu fecha — en la edición nueva que también sale el 15 de septiembre. El OPT o STEM OPT presentado antes del 18 de marzo de 2027 no necesita el I-539.

→ No viajes a la ligera. Si sales después del 15 de septiembre, regresas con fecha fija como un estudiante nuevo.

→ Lo que nadie cargaba antes: pásate de una fecha y la presencia ilegal empieza al día siguiente. A los 180 días, salir del país activa un castigo de 3 años. Al año, 10.

La regla está bajo revisión del Congreso y DHS dice que publicará un aviso si la fecha cambia. Planea con la fecha. No cuentes con que se mueva.

Si tú o tu hijo están con estatus de estudiante o de intercambio, tráenos el I-20 o DS-2019 y el I-94. Te decimos tu fecha, tu techo, y si hay que presentar algo antes. (305) 419-0105

On September 15, "duration of status" ends. For the first time since 1978, a student's status in the U.S. will have an end date.

DHS's final rule (91 FR 44976) changes how F students, J exchange visitors and I foreign media are admitted: not "as long as you're in school," but to a date — the program end date on your I-20 or DS-2019, capped at four years, plus 30 days to leave.

What it means, because this is where families get hurt — between the headline and their own paperwork:

→ Already here? You keep your I-20 end date, but you get a ceiling: November 14, 2030 for F students, October 15, 2030 for J exchange visitors. Nothing past that without a filing.

→ Need more time to finish, or for OPT or a new program? File Form I-539 with USCIS BEFORE your date — on the new edition that also lands September 15. Post-completion OPT or STEM OPT filed by March 18, 2027 doesn't need the I-539.

→ Don't travel casually. Leave after September 15 and you come back on a fixed date like a new student.

→ The part nobody carried before: overstay a date now and unlawful presence begins the next day. At 180 days, leaving the country triggers a 3-year bar. At a year, 10 years.

The rule is under congressional review and DHS says it will publish a notice if the date changes. Plan for the date. Don't plan on it moving.
