Shareholder Josh M. Rubens recently secured a favorable arbitration award on behalf of client Navja Corp. in a dispute arising out of a 50-50 joint venture to develop a luxury spec home in Pinecrest, Florida.

The dispute centered on a long-stalled development project, with the arbitrator ultimately finding that the developer failed to act in good faith to secure financing or pursue a buyout, resulting in a breach of contract and related obligations. The arbitrator awarded Navja approximately $1.8 million in damages.

The ruling was recently featured in The Real Deal, which detailed the arbitrator’s findings regarding the developer’s lack of diligence and the prolonged stagnation of the project.

Meet Associate Madeleine E. Gross, whose practice focuses on probate, trust, and guardianship disputes.

Prior to joining Kluger Kaplan, Madeleine practiced at a Miami boutique law firm focused on probate, trust, and guardianship litigation, where she also worked on complex estate and trust administration matters. Her experience also includes serving as a law clerk at a probate and estate planning firm and as a judicial intern in the Eleventh Judicial Circuit Probate Division.

Madeleine earned her J.D. from the University of Miami School of Law and her B.A. in Political Science & History from Purdue University.

Shareholder Josh M. Rubens recently filed suit on behalf of an affiliate of Miami-based PMG against the condominium association at the Elser Hotel & Residences, its property management company, and the association's board president.

The complaint alleges the defendants improperly withheld funds owed to the developer, including hotel management revenues and condominium assessments, amid an ongoing dispute over control of the downtown Miami condo-hotel.
