The Trump administration is considering a new immigration policy that would allow asylum officers to reject certain asylum applications without conducting interviews, according to internal government documents.

Under the proposal, officers at U.S. Citizenship and Immigration Services could deny applications if records indicate the applicant filed for asylum more than one year after arriving in the U.S. Those applicants would then be placed into deportation proceedings before immigration courts.

Current U.S. law generally requires asylum seekers to apply within one year of arrival, but exceptions exist for circumstances such as serious medical issues, ineffective legal representation, or for unaccompanied minors. Under the proposed rule, officers could still proceed with interviews if applicants appear to qualify for one of these exceptions.

The policy would mark a significant change from USCIS's longstanding practice of interviewing nearly all asylum applicants before making a decision. Administration officials argue the change would help reduce a backlog of more than one million pending asylum cases and prevent resources from being spent on applications deemed ineligible.

Immigration advocates have criticized the proposal, saying it could unfairly place asylum seekers into deportation proceedings without giving them an opportunity to explain why they filed after the one-year deadline. They note that some applicants delay filing because they initially entered the U.S. legally under temporary visas or other protected statuses.

The proposal is part of broader Trump administration efforts to tighten asylum rules and accelerate deportations. As of late 2025, USCIS had about 1.5 million pending asylum applications, while U.S. immigration courts were handling roughly 3.3 million pending immigration cases, including 2.3 million asylum-related claims.

If implemented, the rule could significantly speed up asylum denials and shift more cases directly into the immigration court system.
