Can a trust protect my children’s inheritance?

Who Steps In for You?

“How will I know if the estate (doing a probate) is worth pursuing?”

This is a very understandable concern, but we rarely open a probate without first having a reasonable idea of what the estate contains.

As the client, you will gather as much information as possible about your family member’s assets and debts. Most families already know whether there is a house, a mortgage, automobiles, or bank and investment accounts before we open the probate case in court.

The exact balances in those accounts are not always easy to obtain. Occasionally, a probate case must be opened so we can obtain the authority or court order necessary to request that information. But more often than not, we have a good understanding of the assets and their approximate values before moving forward.

My best advice, however, begins long before probate is ever needed: stay close to your family. Have the sometimes-uncomfortable conversations. Share your concerns, gather important information, and make sure the proper estate-planning documents are in place.

Estate Planning conversations may feel difficult today, but they can spare you and your family a world of uncertainty tomorrow.

Plan early—way before the paperwork is needed. That's why it is called "planning" -- it is done "ahead."

“I already have a will.”
