⚖️ Il 14 ottobre 2026, la giudice federale Jinsook Ohta, della U.S. District Court for the Southern District of California, ha ordinato al Dipartimento di Stato di riattivare le procedure della Diversity Visa Lottery 2027.

📌 La decisione giudiziaria

Nel caso Red Eagle Law, L.C. v. Rubio, la Corte ha emesso una preliminary injunction, imponendo nuove scadenze per l’avvio del programma.

📅 Le date previste:

* 29 ottobre: annuncio ufficiale delle registrazioni.
* 1° novembre: termine previsto per l’apertura delle iscrizioni.
* 3 dicembre: termine previsto per comunicare i risultati.

🚨 U.S. EXPANDS SOCIAL MEDIA SCREENING FOR VISA APPLICANTS 🇺🇸📱

The U.S. Department of State has expanded its online presence review for certain nonimmigrant visa applicants.

Effective October 1, 2026, applicants for I, TN, and TD visas are now included in the expanded screening process and are instructed to change the privacy settings on all of their social media profiles to “public” or “open” to facilitate the review.

This measure adds these visa categories to others already subject to online presence review, including certain student, exchange visitor, employment, fiancé(e), and religious worker visa applicants.

⚠️ What does this mean for applicants?

An applicant’s online presence may be considered as part of the U.S. visa screening and vetting process. According to the Department of State, available information may be reviewed when determining visa eligibility and admissibility, as well as identifying potential national security or public safety concerns.

📌 Important: This does not mean that every U.S. visa applicant is required to make their social media accounts public. The October 1 expansion specifically adds I, TN, and TD visa applicants to categories already subject to online presence review.

Before applying for a U.S. visa, applicants should ensure that the information provided throughout the application process is accurate and consistent.

🚨 ATTENTION! A major change is coming to the U.S. passport application process. 🇺🇸📲

Starting in 2027, the U.S. government plans to begin moving the first-time passport application process online through America.gov.

Currently, people applying for their first U.S. passport generally must appear in person at an authorized passport acceptance facility and submit Form DS-11.

Under the new system, eligible applicants are expected to be able to:

💻 Complete the application online from a phone or computer
🔐 Verify their identity through Login.gov
📸 Take or upload a digital passport photo
💳 Pay passport fees online
❌ Avoid an in-person appointment in eligible cases
📬 Track the application and estimated delivery date

⚠️ IMPORTANT: This option is not available yet. First-time applicants must continue following the current in-person DS-11 process for now.

The rollout is expected to begin in 2027 and will be gradual. The government still needs to publish the final eligibility requirements and clarify whether certain cases—such as applications for minors or other special circumstances—will require additional steps.

The goal is for the vast majority of Americans to eventually be able to apply for a passport book or passport card online through America.gov.

⚠️ The deadline is September 30, 2026.
If you were selected for the DV-2026 Diversity Visa Program, it is important to review your case as soon as possible. Being selected in the lottery does not automatically guarantee a visa or Green Card.

Applicants must still meet all eligibility requirements, complete the required immigration process, submit the necessary documentation, and have a visa number available before the end of the program year.

📋 If your DV-2026 case is still pending, make sure to:

✅ Review your case number and the September Visa Bulletin.
✅ Confirm that your DS-260 and supporting documents have been properly submitted.
✅ Attend any scheduled consular interview and respond quickly to requests for additional information.
✅ Review whether your case is eligible to move forward before the September 30 deadline.
✅ If you are currently inside the United States, determine whether Adjustment of Status may be an option based on your individual immigration history and eligibility.

🚨 Important update: Effective August 28, 2026, the U.S. Department of State paused the issuance of Diversity Visas. Applicants may still be able to submit applications and attend scheduled interviews, but Diversity Visas are currently not being issued.

⏰ However, the statutory deadline has not changed. DV-2026 eligibility ends on September 30, 2026, including for spouses and children applying as derivative beneficiaries.

After that date, unused DV-2026 visa numbers generally cannot be carried over into the next fiscal year.

🆕 What about DV-2027?
The registration period for the next Diversity Visa program has not opened yet. Applicants should wait for the official announcement from the U.S. Department of State and be cautious with websites or individuals claiming that official registration is already available.

🇺🇸 USA: SOSPESI TEMPORANEAMENTE GLI APPUNTAMENTI PER I VISTI DI IMMIGRAZIONE
Nuova stretta dell’amministrazione Trump

Gli Stati Uniti hanno disposto una pausa temporanea a livello globale degli appuntamenti per i visti di immigrazione presso ambasciate e consolati americani. I colloqui già programmati stanno quindi venendo rinviati.

📌 Perché questa sospensione?
Il Dipartimento di Stato ha avviato una nuova formazione dei funzionari consolari per rendere più rigorosa e uniforme la valutazione dei richiedenti, con particolare attenzione al rischio che il futuro immigrato possa diventare una “public charge”, cioè dipendere dall’assistenza pubblica negli Stati Uniti.

⚖️ La base giuridica
Il concetto di public charge è previsto dall’Immigration and Nationality Act, INA § 212(a)(4), che consente di dichiarare inammissibile un richiedente quando, sulla base delle circostanze previste dalla legge, sia ritenuto probabile che possa diventare prevalentemente dipendente dall’assistenza pubblica.

❗ Attenzione: non sono sospesi tutti i visti USA.
La misura riguarda gli immigrant visas, destinati a chi intende trasferirsi permanentemente negli Stati Uniti. Non rappresenta una sospensione generale dei visti temporanei, come B1/B2 per turismo e affari o F-1 per studio.

🏛️ Il contesto giudiziario
La decisione arriva pochi giorni dopo che un giudice federale ha annullato una precedente politica dell’amministrazione che sospendeva il rilascio dei visti di immigrazione ai cittadini di 75 Paesi, ritenendo che il Segretario di Stato avesse oltrepassato l’autorità attribuitagli dalla legge.

🔍 Cosa succede adesso?
Gli appuntamenti interessati potranno essere riprogrammati mentre i funzionari consolari completano la nuova formazione. Al momento non è stata indicata una data precisa per la conclusione della sospensione.

🇺🇸 CITTADINANZA PER NASCITA: TRUMP FIRMA DUE NUOVI ORDINI ESECUTIVI
Nuove restrizioni sul “birth tourism” e sull’accesso automatico alla cittadinanza americana

Il 6 agosto 2026, il Presidente Donald Trump ha firmato due nuovi Executive Orders con l’obiettivo di restringere, in specifiche circostanze, l’accesso alla cittadinanza americana per nascita e contrastare il fenomeno del cosiddetto birth tourism.

📌 Il primo ordine esecutivo riguarda il “birth tourism”, ossia l’ingresso negli Stati Uniti con un visto non-immigrant quando lo scopo effettivo del viaggio è quello di partorire sul territorio americano. L’Amministrazione ha disposto nuove misure per impedire il rilascio o l’utilizzo di visti e autorizzazioni di viaggio per tale finalità e per contrastare le attività organizzate intorno a questa pratica.

⚖️ Il secondo ordine interviene invece sulla cittadinanza automatica per nascita, ampliando le categorie che l’Amministrazione considera non soggette alla piena “jurisdiction” degli Stati Uniti ai fini della Citizenship Clause del XIV Emendamento. Le nuove disposizioni riguardano specifiche categorie di cittadini stranieri e non rappresentano, quindi, un’abolizione generalizzata dello ius soli.

🔍 Le nuove misure non significano che una donna incinta non possa recarsi negli Stati Uniti. L’elemento centrale è la reale finalità del viaggio: dichiarare una finalità turistica quando lo scopo effettivo dell’ingresso è partorire negli Stati Uniti può comportare conseguenze significative sotto il profilo immigratorio.

La portata effettiva dei nuovi Executive Orders dipenderà inoltre dalle modalità di attuazione da parte delle agenzie federali e dalle eventuali contestazioni giudiziarie, considerato che il principio della cittadinanza per nascita resta disciplinato dal XIV Emendamento.

🌎 UPDATE | Proposed change to DV Green Card (Diversity Green Card Lottery) program

🇺🇸 The U.S. Department of State is making changes to the Diversity Visa Lottery (Green Card Lottery). If you plan to apply for the next lottery (DV-2027), here are the key updates you should know:

📌 Valid passport required
Applicants must have a valid, unexpired passport at the time of applying.

🛂 Passport information and upload
You must enter your passport information and upload the passport page that includes your photo when submitting the application.

💳 $1 registration fee
A $1 registration fee will be required when submitting the entry.

📝 Form terminology change
The application form will now use “sex” instead of “gender.”

📅 Implementation timeline
These new rules were recently published and are expected to go into effect around April 10–11, 2026. The official visa lottery registration dates should be announced soon, and the next entry period will likely open after mid-April 2026.
