Your Visa Expired, Are You in Trouble?

It depends.

A visa expiration does not always mean the same thing as losing lawful status. In immigration law, your visa, your I-94, your current status, and any pending green card application can all matter.

For example, someone with a pending adjustment of status case may be in a very different position than someone who simply overstayed with no pending application.

This is where assumptions can create serious problems, especially if you plan to travel, work, or file anything else.

A real relationship does not automatically mean the case gets approved.

You still have to prove eligibility, provide the right evidence, and make sure the application is consistent from start to finish.

Form I-797C is a USCIS Notice of Action.

In plain English, it’s a notice USCIS sends to tell you something happened with your immigration case. It is not automatically an approval.

It can be used for things like:

• Confirming USCIS received your application or petition
• Scheduling a biometrics appointment
• Scheduling an interview
• Reopening a case
• Rejecting a filing
• Transferring a case
• Telling you about next steps

The important thing is: you have to read what the notice actually says.

A lot of people see “I-797” and think “approval,” but I-797C is usually more of a notice/communication, not the final approval document.
